I find it impossible to believe that there isn't an agreement in place. If there isn't, the funeral home is in violation of NY law.
There no doubt was an agreement. The family might not be able to locate their copy of the arrangement that was made with the funeral home but the funeral home should have the original agreement in their records. The funeral home has needed to report on interest earned and on account balance.

Why don’t you read the information offered by the New York Health Department on prepaid funerals. You might learn something.
