Well, my atty filed the motion for modification- using the schedule suggestions I got here:
Mom has kiddo Monday-Thursday, and 3rd wknd
Dad has Friday-Monday drop off on 1st,2nd, 4th wknds
Dad gets Monday holidays from school and spring break
Mom gets 4 wks summer break, Dad gets 8

In the motion she also mentioned his refusal to pay any medical or dental bills.

The ex hasn’t responded officially, but told a friend of ours that he wouldn’t “give in” because right now he has to work most weekends. I told my atty that, and the response I got was, “Well, it makes it harder, but as parents we do have to make difficult choices, and maybe he can change his schedule.”

Does anyone have any feedback on this situation? Is it likely that a judge will say, “nope, if he has to work on weekend, you can’t modify.”

This is not a schedule I love, but I can stand it for a few years if it’ll get kiddo back on track academically. but will a judge go for it with Ex’s work schedule?
