Update and Question

I appeared in court on Wednesday, only to have the judge clear the court room for an 'emergency' and continued my case until Monday. The judge wouldn't transfer it to another courtroom and would not take into consideration that my child missed school nor that we lived 180 miles away. Now my son will have to miss another day of school and I will have travel back to Philadelphia again.

Does this help my case of proving inconienient forum? My son was ordered to appear and now will be missing another day of school. Or is it irrelevant?

That is irrelevant at this juncture.

It's pretty much irrelevant.

However, why does your child have to miss school? He's 12 - surely he has a friend who he could go to school with. Unless there's a strong reason why his presence would be needed (and given what you've posted, I don't see any reason for that), let him go to school.

The order to appear stated that the child had to be present. :(

I really think you need the assistance of a local attorney.

While I'm not as sure that you're making things up as some of the others are, I can say that if you're telling the truth, this is one of the most bizarre cases I've ever seen, so all the information in the world about how things SHOULD work won't help you.

I have a local attorney. He told me he called the courthouse and asked what happened and they were being very hush hush about why the judge closed her court. He said in the 30+ plus years of practicing law, he had never seen that happen before.

And I wish I was making this stuff up.
