How can anybody force a child to live with the parent he doesn't want to live with?

Because according to the law and anybody with a brain, a CHILD is not mentally and emotionally able to make such life altering decisions. If he could, he would simply chose the parent that let's him get away with more. A CHILD is simply not capable of making that decision. Please get grip.

It's called being a PARENT.

You have yet to provide a reason why the court should change custody, apart from it's what the kid wants.

He also didn't choose to have his mother as a parent. She is mantally unstable and he's the ONLY person she'll attack whenever she has "one-of-those", way to many times, break-downs.

So because she is his parent she can use him as an object and do what is best for herself, right?

Look - let's make this simple. Dad has to PROVE that Mom is unfit. Period. Then a JUDGE will decide what it in the child's best interests. Not the child, and certainly not you.

The stability of mom's mantle has now bearing on whether or not she is a fit parent (although it may be considered a safety hazard). If you meant that she is MENTALLY unstable, considering you keep answering your own questions, I don't think that YOU are really fit to be the one to judge ANYONE'S mental status!

this is what CA says

3042. (a) If a child is of sufficient age and capacity to reason so
as to form an intelligent preference as to custody, the court shall
consider and give due weight to the wishes of the child in making an
order granting or modifying custody.
