She is in WV.
The only arrears I have is for my son,not my daughter. I am sure my mom is trying to establish a case to get child support and combine cases together. It is so confusing. I just think she is in the wrong.
I am honestly trying very hard to assist you, but you are making it really hard. What son? How old is he? Does your mother have/had custody of him and does she have a CS order for him? If your mother doesn't have nor had custody of him, who did?

No I haven't. I don't care for the state lawyers,I think they are out for the state not their client.

How old was your daughter when she moved back in with your mother? Your mother did not have a valid child support order because that would have been cancelled out by the child support order that your aunt received. Therefore your mother would have needed to get a new child support order after your daughter moved back in with her, in order to get arrears.

You do not do a very good job of explaining things. People have to ask you too many questions to get a clear picture of what is going on. What you need to do is sit down and write down a factual timeline of what went on so you have it to refer to if you need to speak in court.

For example, it should go something like this:

My mother had custody of my daughter from XXX date when she was XXX years old. I was ordered to pay child support and I paid it faithfully.

In XX of 2008, when my daughter was XX years old, my aunt in NY obtained official court ordered custody of my daughter, which included a child support order.

In XXX date of XXX year my daughter, who was age XX moved back in with my mother.

My mother attempted to get a child support order on XX date of XX year but it was thrown out because my daughter had already graduated from high school.

My mother is now attempting to try to get arrears against the old child support order that was cancelled out by the new child support order when my aunt got custody. I ask the court to dismiss her case.

And explain about your son while you are putting together a, hopefully cogent, timeline regarding the support orders issued to you.

He is grown up. I do owe arrears on him which I am paying on. It was court ordered. I am not worried about his at all. The WV child support agency,is saying the case from NY on my daughter was transferred to them. It went through courts here in WV,and was dismissed. They are trying to make me pay for my daughter who has reached the age of 18,and wanting to combine the totals arrears together. I hope this makes sense.

Who has the support order regarding your son? Please clarify the bolded comment. You stated that you didn't own arrears at the time your daughters CS order was stopped. If you didn't owe arrears, what is it that your mother wants to combine?

You don't need to leave the forum...just post cogently. We honestly do wish to help you.


Take a few min's and write out the time line for the CO's regarding both son and daughter. Have someone read it to make sure it makes sense. AVOID using pro-nouns as that make things confusing. :)

I was suggesting that you do the timeline to help you prepare for court. So that you have something to refer to so that you will include the facts that are important, and leave out the things that are not important. I wasn't suggesting that you needed to leave the forum.

People really want to help you but are as confused as I am. I am afraid that without an attorney that you will be squashed in court especially sine others likely will have professional assistance.

It will also be helpful in the future if you have copies of all court filings and responses in your hands. Include copies of all your communications with or from child support service agencies. Get them very organized by date. This will help you add these to your timeline.
