child support laws?

no she was not collecting benefits all that time, she only collected them for about 1and half years.
please go back to first thread and u will see that she asked the courts not to enforce the support order! She took off with the kids and i tried to find them. I was unable to find them. Now i know there were a lot more ways to find them but at the time i had neither the means nor the knowhow. So how would i be able to prove that she hid the kids from me? What kind of documentation would i need? And how would i go about finding it?
Considering i didnt know where they were? I know most if not all of you are trying to understand. What would constitute proof that she hid the children from me?

All of your little pieces might make sense, if they weren't bundled together.

If mom got public assistance, then she would have been forced to either cooperate with CSE in locating and enforcing child support, or show just cause, such as former abuse, fear for her safety or the safety or the children.

You never went to court and demanded your rights as the NCP, so what would she have been hiding from??

If she went to court and filed to waive back child support, then why would you be paying it now??

What did you do to try to locate them?? other than running into an occasional relative in a grocery store or something and asking hey have you seen "Mary". No, oh, well thanks anyway.

What about the money for the kids? you know the child support, I see you never responded to the idea of starting an interest bearing account, since hey, you say that it is all about the kids and what you have missed out on with them, what about what THEY missed out on, a father who supported them.

You finally found them using a paid search company, what did that set you back? $29.95, and what happened when you located them????

First there would have had to have been a no removal clause in the orders ( or a general State Law ) . Then a violation of your rights . The Party of the alleged violations would have had to understood the orders and knowingly and willfully violated them .

Even IF you filed a contempt Petition and prove all these aliments , Child support arrears can not be terminated or erased . Plus you have the State that came after you that you now owe arrears .

You have said nothing about being served a Petition for Child Support from that State , or what your response was to the Petition .

We do not know what your orders state/Stated . We do not know if you were served a summons for child support from the other State .

We can not give you any accurate information without knowing the facts .

One fact is it has been 15 years , and you may not even have a chance at getting heard in a Court room over the issues at this late stage .

there was no divorce or child custody filed she just took off with the kids after i got out of the hospital. the only order was to pay the child support and she told the court not to enforce and left. NO i didn't go to court and demand my rights at the time, when i went to the court for the support case(before i was in hospital) i was told by the district attorney who was handling her case for free by the way, that child support and child visitation were 2 seperate issues and i would have to get a lawyer to fight for that. She didnt go to court and file to waive back child support, she told district attorney not to enforce the existing order and then dissappeared understand? The state says i owe them for the aid she recieved while on their program AFDC. As to the money well if u dont have any since i was getting 600 a MONTH from SSDI it was kind of hard to save any. after that i got a job after being on SSDI for over 2 yrs. Next have u EVER tried to find someone who doesnt want to be found? And for ur info it cost me $1500 to finally find them! And I hard a hard time scraping that up, all of us are not made of money nor do we have the luck or skill to be able to have 3 jobs at once, or even get 3 jobs. It is extremely hard for me to dredge all this up at once so bear with me, it reminds me so much of my son who died and the loss of my other children, and brings back lots of bad memories of that time.
