Any criminal charges against a perpetrator would need to be filed before the victim turns age 25 (for misdemeanor sexual offenses) or age 28 (for felony offenses). The Act, however, would allow for pursuit of a civil action up to the age the victim turns 55.
The law amends the statute of limitations for a victim to sue for injuries caused by certain sexual offenses committed against them while they were children so that the time to pursue such an action expires the day after the victim reaches age 55. There are no provisions in it that would allow a child victim who is now past his or her 55th birthday to pursue a lawsuit.
