What is the name of your state?What is the name of your state? PA. I have a credit card debt from the year 2000. The credit card company turned it over to a collection agency and now they are calling my house every day, and sending me certified letters in the mail, saying that if I do not pay it back within 5 days, that they are going to file a small claims complaint against me, so I was wondering if they can do this?, since this debt is 6 years old already. I was wondering if there is a statue of limitations on credit card debt?

The SOL in PA is 4 years, this would start counting from the last time a charge or a payment was made on the account, not from the time the account was originally opened. So if you have not paid or charged on the card in 4 years or more, then it is past the SOL.

This does not mean they cannot file a suit, it simply means that you can use that as your defense when you appear in court to have the suit dismissed as the debt being time barred.

You can send them the Cease&Desist letter if you wish, but before you do, make sure you are definitely past the SOL, because if you aren't then you leave them no recourse but to sue you.

This also does not apply if they have already sued you at some point in the past and already have a judgment against you. Those are good in PA for 6 years and can be renewed.
