what I asked was this! "CAN HE GET GRANTED A NO CONTACT ORDER WITH NO SUBSTANTIATING EVIDENCE i.e. SPECIFIC EVENTS, OR CIRCUMSTANCES IN WHICH I ENDANGERED THE CHILD?" solely basing his allegations on my past criminal history? somebody with actual legal knowledge respond please.
Somebody with actual legal knowledge did respond. The answer was "yes, he can."

The "crystal ball" comment was a reference to the fact that while we can all tell you the child's father can, nobody here can tell you if he will.

okay that is understood, And thanks for your advice, So he can ask for it, But does anyone think he can actually get it approved??? If all of a sudden after My fiance and I currently living in the household for 6 months together, Ad her ex- totally being okay with me around his child, But now all of a sudden ..I am a danger? I think the judge will think that anthony (her ex) was jsut trying to pull out straws and this was a bad attempt..... Also Her ex is currently heavly intoxicated all the time on meds, and is in current viloation of HIS probation, (which just might land him in jail in the next week) So how agrees that he will actually get it aproved?????

Understand this if you understand nothing else: the judge doesn't think like you do.

But here ya go, My own name here, I was merely speaking for Phoenix down (he has better gramer than I do) lol But seriously, Is there ever any attorneys here to post advice? And I have an attorney, and he is going to rip into my ex sooo....

ohiogal is an atty, but she still can't tell you what a judge will do. All of us are going thru something of some sort- that's how we found this place. and most of us have been going thru it 4 years and been in and out of court rooms quite a bit. You should listen to these ppl- they volunteer their time to help.
user names matter because it gets very confusing figuring out who is talking about what- it's a common courtesy thing

This is a LEGAL forum. Not a fuzzy warm place. As for Phoenix, it could very well matter. More so than dad's past. Why? Because DAD is dad. You chose him. Phoenix is a legal stranger. Always will be. Those are the major differences. What will the judge do? Who the heck knows. You need to realize however that the parents (both mom and dad) have superior rights to be a parent over anyone else. They can be bad parents and still have custody> HOWEVER when you bring in a legal stranger that could be trouble... well a legal stranger has NO rights.
