Ok,
What would you add or correct in what she said? What do you suggest? what advice can you give me in respect to my case?
Thank you all so much,
I want to go in there with realistics expectations.
What do you mean by 50/50 custody? Do you mean joint legal and physical custody or do you mean JOINT time? Let's start there.
Then it becomes what do you think is okay and what does he want? Does the protection order include the children?

Hi,
I mean 5050 joint physical custody. The oldest boy is included in the PO, I obtained it when I was pregnant with the second. The oldest was added because he slapped me in front of him and hreatened to take him away if I don't drop the PO (via text) . He wants 5050 joint physical and legal (mainly to avoid paying CS, we earn about the same thing). I believe the kids will benefit from knowing him but eow not 5050 joint physical, not now, they are so young and he can't handle them (I know this but can't prove it).
Also I don't want the kids to be separated so whatever he will get for the youngest I want it to apply for the oldest.

(This has given me sleepless nights already)

Thank you,

K. K.

The reality of things is that 50/50 is not the norm anywhere, and certainly not the norm where one parent has been missing from the children's lives.

It is in your best interest to at least consult an attorney. Since you say you do not qualify for aid or assistance from your local DV group, borrow from family, work overtime, get a loan, or whatever for a couple of months. It will benefit the children and be cheaper in the long run to do it right the first time.

Working overtime and saving for that.

We hope the overtime will be necessary for only a short time so you can really enjoy your little ones.

You are in a difficult position at this time; keep up hope that it will get better for everyone.

When you get court orders, follow them; get child support through your state agency.
