With the added information, I have to concur with Humusluvr. I have prosecuted parents for child neglect for leaving bruises like that on their kids - it certainly is not acceptable for a teacher to do so (under the conditions described here, at least).

Keep pressing the police. Go to the DA if you have to. Good luck.
Is the child at school? With the teacher?

My daughter had the day off from schooltoday.

I finally received a call from the principle at 3p today.

She said she had the teacher appologize to my daughter.

I told her that I didn't feel that this was an appropriate outcome.

After work I returned to the police department and told the officer what had happened. he said well lets fillout a report.

Filled out a report. Wrote a letter to the VT dept of education, the county supervisory union, and the middle school. Same letter cc'd to all.

Please let us know how it turns out. Are you sending daughter to school tomorrow? With teacher?

i had something very similar happen to my 4 year old son the last school year. in front of my husband, AND in front of FOUR other teachers. while my child was not bruised, her (the teacher aide) was physically aggressive with my son. as he is non-verbal, he could not give his own side of the story. however that teacher's aide was no longer permitted to teach in the same class as two of my children. she's not even at the school this year.

keep at it. don't take no for an answer. and keep talking to someone higher up. this is unacceptable.

I am sending her tomorrow, only because the sgt. wants to speak to her at school tomorrow. He asked if it was alright.

The sgt. said he thinks the teacher isn't there anymore...but I don't know if she is.

The teacher that did it is not my daughters normal teacher. She works in special ed. (which in my mind makes it worse!)

Please, accompany her, listen to what the sergeant says, and ask that teacher be re-assigned until a full investigation is completed.

That's not "fooling around" if some random teacher grabs your child hard enough to leave bruises.

That *could* be considered assault.

As a previous poster said, don't take this lightly, and don't take excuses. You could save a life, you never know.

I am sorry that you, and your son, had to go through this. It certainly is frustrating and shocking. I honestly never would have thought I would have to deal with such a thing.

I am glad that your son did not have to have the same aide, and that she is no longer there. I can only imagine if she would do that to your son who else she could have done it to.

Very upsetting. And there are wonderful teachers out there. These types of things just ruin it for the good ones.

How easy does your daughter bruise? I know some people bruise horribly from a simple needle injection.
I wouldn't say that she bruises easily. She is a tom-boy and certainly plays hard. She has gotten her fair share of bruising but I would think given what she has been doing prior it would be expected.

So to answer your question, no I don't think she bruises easily. I think that the teacher had to have grabbed her pretty hard in order to leave the mark that she did.

Tonight being more than 24 hours later, the bruise looks worse (of course) and very purple. The officer asked that I take another picture of it when I got home, which I did.

On another note the teacher is still calling. I believe that it is up to 41 calls now. From 2:30 yesterday afternoon.

Where is s/he calling from? Call the phone company, block the number. Or take the phone off the hook. Report this also. It's crazy. What if s/he shows up at your house? Report this to the police.

I told the officer when I filed the report. I also gave him the phone log I printed from the computer last night. He wanted a copy. But since I got home I checked my phone and there was continuous calls. She is calling from her house phone, and her cell phone. Some of the calls are 2 or 3 minutes apart. I turned off the ringer about an hour ago, because I didn't want to keep checking the caller-id to see if it was someone else calling. But I figured anyone else can just call my cell phone.

The problem is she must have gotten the number off the school records, and she would know my cell and work numbers. Thankfully she has not called any other number than my home.

*ETA: I would like to thank you all very much for your help. It is an upsetting situation and it helps to have someone to offer third party advice.

That would be a violation of her employment, for her to check the records of a student that is not hers. In my school district, that would get you fired FAST. We used to have teachers check on other teachers kids, or kids they didn't like.... our district put a stop to it fast after FERPA. Report this to the principal also.

Your welcome :) I'm looking at this through a lot of lenses. I have experience as a teacher, principal, professor, and I know what I would do as a mom. You're doing well.

I think the bruising is odd. I think the numerous calls are unstable.

I work in Special Ed. with some very volatile students. I've trained in and used several different crisis intervention programs and NONE have ever resulted in this type of bruising. As a special ed teacher, she may not be "licensed" for any physical intervention but she has way more training on this subject than the average teacher.

She flipped. She knows it and is scared. I'm darn sure she was told NOT to call you at all.

As a parent, I wouldn't want her jailed or necessarily fired but I'd like a suspension pending counseling and treatment plan. There are plausible circumstances in which she would deserve some understanding, but not a lot.

I agree that the phone cals are unstable. She began calling today at 7:17 am, as of now the last call on my caller-id was 9pm.

Yesterday the first call was at 2:30pm, and she stopped calling at 9:22pm.

What I don't understand is that the police said they were going to talk to her, I assumed they meant today/tonight. They had the record from yesterday and the first 2 calls this morning. I would assume they would tell her not to call me. So I can't imagine why she would be continually calling?

i honestly wasn't thrilled with my outcome. "so you take her out of my son's class and stick her with OTHER children?". i had and STILL have issues with that. the director declined to comment on my question. she was also a special ed aide.

my son's counselor made it very clear to us in a parenting class. we are our children's FIRST line of defense. and no one, NO ONE should be a stronger advocate than we are for them.
