Dude - your g/f's kid in NY has nothing whatsoever to do with OP's kid in FL, now does it? If you're going to use it to prove a point, make sure it applies to the OP's state, eh?
I would expect the other attorney to object very strenuously to allowing hearsay evidence such as you describe, BL.

I was making a point about hearsay , eh ?

So it's more likely that your statements were corroboration of what was said in therapy. In any event - law in NY is moot in FL.

I did say I didn't know, but It would be something to run by a FL. attorney to see if it applies in that State .

I cannot give you any legal advice just some advice from personal experience. I live in Florida. My ex is constantly putting the kids in the middle over everything. The things he tells the children make my hair stand on end. I tried going to court over it....but it doesn't seem to make a difference. Like another poster said you'd have to see about having the kids testify, and thats just going to really put them in the middle and make things worse for them.
I have learned to just take myself out of the game. I have tried to co parent, but you can'r coparent with someone who is looking for any reason to mouth about you to the kids. Now I just deal with my ex in a professional matter. I send most things by email so there is no debate over anything that one person has supposedly said. I follow our shared parenting agreement to the letter. I only deviate if it is in the children's best interest. When the children tell me things that their dad says or things he shows them that he should or shouldn't I just hug them and tell them it will be ok. I tell them its an adult issue. I have the kids in couseling. I let the Dad know of course. All you can do is be there and be the parent your suppose to be. Eventually it will pay off. I know it is hard....but if you are there for your children in the end they will know it. Sometimes you just have to come to the reality that you can't stop people from behaving a certain way even with a court order....you can't control what they do but you CAN control how you respnd to it and your children will remember and carry that with them for a lifetime.

Condolences....I understand those kinds of "bittersweet" things. We have some of that in our family too.
