help me. i am a NY resident. a debt collection agency has called my house 4 times about 3 weeks ago looking for someone who doesn't live there but has the same last name. I am unsure what the call could be about but, i have a guess.

i paid about $500 for some study materials that included updated materials once i completed the batch they sent me. the sent the second materials but, only then, they informed me via email that i had to return them or pay $300, even though I already paid for them. i never sent them back. they emailed me twice asking me to call but, I never did. my guess is it is a way to keep the stuff off ebay and make sure people buy their stuff.

anyway, could it be that? fyi: my mother paid for the materials via check, not cc. can this affect her?

anyway, what, if anything, can be done to me legally and credit history wise? what should I do?

tx everyone, i need help.

Could be.
Also could be the NY Lottery calling to tell you that you won $1 Quadzillion Dollars!!!

Depending on the FULL facts, maybe.

They could send 'Uncle Vito' to visit.

what should I do?
Hmmmm... maybe actually TALK with them??

NO, it's not the lottery. It's the Takhar Group out of Ontario, CA. A debt collection agency.

what other facts would help determine this?

and say what? I'm not the person you called? I do not want to stick my head in the sand but, I don't want to help them either.

as sarcastic as it is, thanks for your response. i need all the help I can get.

Do a google search on the phone number they are either calling from, or the number they say to call. Send them a letter that the person (name them) does NOT live at that location and to NOT call YOUR number for said person.

They sometimes try EVERYONE to see if that person possible lives there.

thanks. i'll try that. although, i get the feeling that won't be the end of it.

if they are trying to contact me re: the materials, can they affect either mine or my mom's credit without contacting me first? what is the procedure there?

Settle up your bill with whomever you owe.

In your first post, you said:
looking for someone who doesn't live there but has the same last name.
It can very well be that they are trying EVERYONE with your same last name hoping to find that debtor.

that's just it, i don't I owe anyone anything. nobody ever said that I would have return the materials until after I paid. plus, i'm fairly certain the Statute of Frauds applies here or parole evidence rule barring any claim for $300. i'm just guessing that this is what my house is being called about.

anyway, i'll send the letter or answer and tell them that person doesn't live there.

tx a lot for your help. do you know of a website that gives a general idea of how the collection process goes? i'm wondering why anyone would bother hiring a collection agency over $300.

tx again.

MOM ordered the stuff for kiddo. Kiddo didn't follow the rules.

YES, it CAN affect her credit

no. mom merely paid, not ordered, big difference. kid followed rules. but even if kid didn't, it's not mom's problem. if kid had convinced a stranger to send a check, stranger wouldn't be on the hook.

Betcha mom's name is on the order...
(If it was kiddo's name, they'd be calling kiddo)

what sort of information must a collector provide to a CRA or CB in order to place a mark on someones credit? they must substantiate their claim somehow, correct? also, is not being able to find someone a excuse for providing validation for a claim?

anyone have info on this? basically two questions: 1) if i hire a collection agency, what information do i provide them? and 2) if i wanted to report someone to a credit agency, what information must I provide?

tx in advance

Yes, I have that info.

No, I won't tell you.

From what I read in this thread, I think you are a crook.

why am I a crook?

also, i find it interesting that you would take the time to write that you have the info but won't share it, rather than simply not respond. it goes without saying what I think you are... :)
