Her wording is a little odd but I am guessing that the insurance company wouldn't pay out as much for the damage as the person wanted, hence the lawsuit.

Then you might want to expand on your question, because that is what I understood you were looking for, so the OP might get confused.
Let me ask it again:

I agree that the insurance company refused to pay the other party. I believe that the OP may have misspoken, so I am simply asking for clarification of the actual statement that the OP made.

Progressive was asking 19,000 for the damages done to the pick up by my dad with a commercial insurance. Our commercial insurance offered 50% of the asking price and they denied the offer and so that is why they are going after my dad personally.

What reason did the insurance company give for denying the claim?

Right on!!! That’s what is going on. Because our insurance refused to pay the requested amount they turned to us the “insured”. So what can I do in this situation?

You state that your dad was diagnosed with dementia, but has he been declared legally incompetent?

Really, you need to push the insurance company on this. They should have provided for his defense, and they should pay the judgment. There has to be a reason why they haven't done anything, so you need to find out what that reason is. I suggest that you stop faxing documents and start mailing documents via US mail with tracking.

If that requires to go through a judge then no. I haven’t done that for him yet. I do have power of attorney over him for now.
