My husband is buying a home for us in AZ. We presently live in a home he owns and will be selling in IL. We've been married almost 3 years. He's 49, his first marriage, I'm 46, my second. No children, either of us. No prenup. It is his money being used for the house and he wants me to sign a Disclaimer Deed. I'm ok with signing something that says I won't take what is his if the marriage ends. My only concern is what happens to the house upon his death if I sign the disclaimer. Will a will override that? Thank you.

There is no such thing as a disclaimer deed. Is he paying all cash or going to be solely on the mortgage loan?
If done the correct way, upon his death the property will go to his designated beneficiaries pursuant to his will. There may be legal problems if your State is a community property State.
