I think a bad review about something frivolous like maybe they forgot to give you an item is different than giving someone a wrong drink causing them to be ill. That's more serious. No company no matter who they are would want that to be out there.
really? remember Stella Liebeck? McDonalds spent a lot of money arguing that case and she got her crotch scalded and spent considerable time in a hospital.

You are believing you are more important than you are.

so, did the hospital take a blood test and measure the levels of caffeine in your system? If not, all you have is that they agree with your suspicion with no supporting evidence.


That's an EXCELLENT question.

Because y'know, that would put to bed at least half of the question.

And a hospital, when faced with a patient afflicted with what THEY think is a hypersensitive reaction to caffeine would absolutely take blood to check.

So.

so, opening arguments of the defense:

here we have a woman that was fully aware she was hypersensitive to caffeine yet she continually decided to tempt fate and order a cup of coffee. While she will argue that she ordered "decaf" and that she had drank the same drink many times, I want you, the jury to think about this:

if I shot myself one time and survived, would it make sense that I could shoot myself any time I wanted to and expect to survive? Of course not. Just because a person escapes injury one time does not make it so they will always escape injury. I am fully aware that a gunshot could kill me. She is fully aware that the consumption of caffeine could cause her to experience a medical emergency. Here we have a woman that tempted fate and lost. She intentionally consumed a drink she was fully aware contained caffeine with the belief she could not be harmed simply because she got away with it previously. I wonder, how did she realize she was hypersensitive to caffeine. She claims she knows she is so that would mean she has previously experienced enough of a reaction to seek medical attention and be diagnosed. Would you ever consider risking injury if the reaction was severe enough to have sought medical treatment? Would any reasonable person tempt fate in such a way and when injured, argue it wasn't their fault. I think not. That is why we, as defendants, are denying her claim but since we believe this is simply an attempt to milk the system and a frivolous action, are asking for $1.5 million in damages including legal expenses and a claim of defamation.

@justalayman, are you really that ignorant? Caffeine high I didn't like? Why don't you get educated about things. (And try saying that to everyone who have food sensitivities and see how you get out of that one :rolleyes:) I don't consider what I went through (or what other people go through when they have severe reactions to something) something anyone else would enjoy either. Unless you personally like feeling so sick that you think your dying or something enough to warrant a hospital visit, if so clearly you have issues. And what's up with there always being one person on forums that have to have a nasty attitude towards people just seeking help? I don't understand the hate. I thought I was on a forum where people with legal knowledge (lawyers, law students) help others. No? I'm not looking for answers from people who have nothing better to do than troll.

This thread has gone to hell but let me try to ask a simple question.

Do you have an opinion from a doctor that what you experienced was a allergic reaction to caffeine? Without that I don't see how you have any chance of success.

What comes to mind to me is the vegetarian who ordered a BEAN burrito from Taco bell and was given a BEEF burrito, and got sick and sued. From what I remember he did get some kind of settlement but I'd have to google to get the actual details.

those are only available during Halloween season which is over a half year away. Any left over non-caffeinated eyeballs BP might have are most likely stale by now seeing as they had to be from at least last October.

I really have nothing to add to this thread....

Being allergic to caffeine since 3 years old- try explaining to a 3 year old why he can't have any chocolate anymore- I discovered that my tolerance for caffeine got lower the older I got. Ultimately even the smell of caffeine can give me an upset stomach.

5 points to anyone who can answer if I avoid caffeine? :D

Just throwing this out there- even though the OP has gone- I wonder if the OPs tolerance to caffeine may have gotten lower due to the repeated exposure to caffeine over the years.
