from what I understand you will have to file divorce prosedings and the marital assets will be divided by courts according to laws in your area where filed it is always advisable to use an attorny to file proper papers to protect your property otherwise your husband could refinance and take all the equity before the settlment and you would be sol

Many cases on point to the general principle of equity acquired on a jointly resided dwelling during the marriage is "marital property" in Florida. That won't do you any good if he sells the property and attempts to vanish, however. Locating the guy and receiving any cooperation from him can take many $$'s and much time. You might be able to file a temporary injunction prohibiting the dispensation of the former marital residence, but you are in need of formal legal counsel. Most Fl counties offer free legal services for the needy or for people in specific situations. Go to your county's website or to the courthouse for more information/guidance. Do seek professional help asap.
