WHERE: IOWA
WHAT:CRIMINAL LAW
BACK STORY: (My best friend has been arrested and charged for domestic abuse... 2nd offence... it should be noted she has a prior domestic on her record. so to clear any confusion they both have a prior conviction of domestic abuse... After he was arrested and charged several witnesses to statements made by the female protected party. Indicate they overheard her brag about having her daughter hit her to leave marks and even the daughter has admitted to doing so... My friend hopes he will be advised to mend the relationship because she will confess she lied (purjer herself and this will go away or could.)
He does have a lawyer... im not trying to burst his bubble but I dont think there is a remote chance his lawyer will advise of this regardless of the victims willfulness to admit they pied and broke the law. especially when a NCO was issued but i cannot determine weather its active or not or have had trouble finding its status (most likely not disclosed due to nature of case) but he seems to think its plausible.. i forsee more legal troubles potentially..
THE QUESTION: Is he crazy? or is this plausible?

Long story short my best friend chose the worst possible person to share his life with. He has been arrested and charged for domestic abuse... 2nd offence... she has a prior domestic on her record. so to clear any confusion they both have a prior conviction or domestic abuse... After after the arest several witnesses to a statements made by the female protected party complaintant.. stated they overheard her brag about having her daughter hit her to leave marks and even the daughter has admitted to doing so... but yet my friends seems to think or believe she will purposefully purjer herself and this will go away..
He does have a lawyer... when asked what he even thinks his attorney will tell him is theres a chance ?!?! my question is there any one that would think a lawyer would even for a second tell his client to trust the "victim" to just tell the courts they lied at almost certain penalty of law... im serious i just need as many answers of Crazy or plausible...
What state?

Your friend needs mental and legal help.

Once someone has made allegations against you, to the point where you are arrested, there is no relationship worth salvaging.

And no, "mending the relationship" will NOT be considered a healthy option by the court. Real abusers routinely ask that they be allowed to salvage the relationship, and minimize their negative behavior - how's the court to know that's not going on here?

Healthy relationships are built on a foundation of trust.

My legal advice to your friend:
1) Work with his lawyer. Do not encourage fantasy.
2) Absolutely end this "romantic" relationship.
3) Get therapy. Contact a domestic violence organization for suggestions of the best options for this. And yes, this is legal advice, because taking steps to address your problem is looked upon favorably.
4) If there are mutual children, get them into therapy. If the daughter mentioned is a minor mutual child, especially ask for court ordered therapy. If these kids have witnessed or participated in domestic violence, they need therapy. Yes, this is legal advice, because whatever is going on in that household, it's bad. The kids have been abused and they need a mandated reporter on their side.

This is just a start.

"Any Christmas that doesn't include police in your kitchen isn't half bad."
