I have coordinated countless water leaks between owners as Pres. of our HOA over the past 9 years. Our water pipes run up community walls and into the units. Bathroom leaks are usually 1 of 3 things. Two of which would not be visible from the upstairs unit. Leaking toilet rings and tub drain caulking may not be visible from the upstairs unit leading upstairs to believe that they don't have a leak. In my experience it's always been an upstairs leak.
The leak can not be ignored. We would have the owner's coordinate the upstairs unit to call in a plumber and have access to both units to located the problem. In some cases, the ceiling downstairs, with the owner's permission, was partially removed. Repairs to the interior of the downstairs ceiling is the responsibility of the downstairs owner.
If upstairs refused to address the leak, we would utilize our right to enter and call in a plumber letting the owner's know that the invoice would be added to the owner account if it was determined it was not a community element. Only has to do that once.
