What state are you in? Pennsylvania

So I made it through the DUI, the arrest, the probation, and now alls I have to do is get my arrest expunged. I briefly inquired about expungement with my probation officer, but she didn't seem very interested in explaining it to me and I didn't want to push the subject. I emailed my lawyer about it and he said it would cost $350 for him to do.... yeah right. I would much rather do it myself if it's possible. Any information on the expungement process would be much appreciated. Thanks.

This is what my PO sent me.
"In order for the record to be expunged, you will have to contact your attorney and have them prepare the expungement paperwork."

So I don't entirely know what to make of that... I'll ask her a little more thoroughly next time I talk to her.

Thats very cheap, I go with him.

Good to hear you made it thru. Question for you. Did you go thru the ARD program? If so, was this your first offense? How long did you lose your license for? How long was the class you had to go thru? Thanks in advance.

If you successfully went through ARD and the charge was dismissed you could get it expunged. If you were actually convicted, you ain't getting it expunged.
 
License suspension with the ARD program: general impairment - no suspension,high rate - 30 days,highest rate - 60 days. Classes depend on the county,here its 6 classes during the week or 3 saturday classes and 6 months probation. You also will be required to have a alcohol evaluation. Start planning now how you will get around,save your money,don't drink and drive ever again,etc.

Expunging records

$350 does sound like a reasonable amount. Most of the fees I hear in the central PA area are much higher.

If you cannot afford that, or are unwilling to spend that amount of time, you can always spend some time at your county courthouse researching records for prior expungement orders and any related documentation found.

Keep in mind that many records are destroyed, to include any police reports, with an expungement order. Hence the name expungement. About the only trace remaining may be a notation on a driving record from Penn DOT.

That is correct. I believe the OP was talking about expunging the arrest records.

I waited the required 7 years as per PA statutes- then found out by contactng
the County Courthouse that I had to apply for expungement. I went through all the
paperwork; it wasn't tough and I didn't need an attorney. The expungement was granted
by the court less than 3 months after I applied.
Now, 1 year later, I just rec'd a driver history and it is still on there!
I am posting this as a new question post as well because of that. :rolleyes:
 
Correct me if I'm wrong, the expungement is for the criminal record. It stays on your driving record 7-10 years something like that.

that is correct. I was searching for this on google and came to this thread. good thing I belong to the site cause its 3 years old. yes, expungement is just for criminal record and really, not even sure DUI's show up unless there were some extenuating circumstances. it will still be on your driving record for what is now 10 YEARS!!! I wish it were 7, but it is what it is. ....

Yep, my attorney is getting ready to file my paper work as well. He charges $350, but also pays all of the court fees associated with getting the paperwork in order and filed. A pretty small price to pay for such an important step in process, IMO.

I still need to ask my probation officer what exactly gets expunged and what I am required to answer on the "have you ever been arrested/convicted" section of every single application for anything, ever. I also need to find out, how say 6 months down the road I can background check myself to make sure it's actually followed through.
