DUI (Missing Complaint Continued)

What is the name of your state? California.

I was Taken in for a DUI and given a court date.
Upon going to Court I was given paper work and told
that my complaint was missing and a new court date
would be some time in 2005. At this time the court will
not press charges It turns out they have lost my file.
My questions are:
(1) What are the chances they will find the missing file ?
(2) Is this something a Lawyer deal with quickly ?
(3) Is There a time limit to when the case has to be dropped ?
(4) And any other useful Advice on this matter

Possibly. I'm not sure how fast the case could be forced to trial, or if it even COULD be "forced" before the next scheduled court date anyway. Since you are not in custody, the normal speedy trial rules do not generally apply.


(3) Is There a time limit to when the case has to be dropped ?
Yes. You'll have to ask your attorney what that might be. Chances are its one year if this is a misdemeanor. But, I am not certain.


(4) And any other useful Advice on this matter
Okay - don't drink and drive.

What exactly is "MADD talk"?

If you mean any conversation that says that driving while intoxicated is stupid and dangerous, then I guess I just said that ... though I didn't say it in a negative manner, did I?

Though I suspect that DUI was considered dangerous and dumb even before MADD.

So are you saying that at this time you have been not been charged with anything?

The government has a certain time (called statute of limitations) within which to file a charge.

Was it misdemeanor or felony DUI you were arrested for.

Details...details....

Correct At this time I have not been Charged with anything,
They Even Stated at the hearing that the courts have not decided if
they are going to press charges.

It Was a misdemeanor I believe (My 1st time ever being arested in 35 years)
But I am not Positive because there were no Charges brought against me as of yet.

As far as more details I am not srue what else you need but feel free to ask.

I Asked The Attorney I am thinking about Hiring what the chances were that the case would move forward, He Stated that about 75% of the time it works out in Favor of the court.

At this point I will take those odds and if they press charges I will be up in the air between a Public Pretender and a DUI specialist, Im not sure I can justify spending $15,000 to $20,000 on a trial with a to specialist.

No That's Fine when you mix information with your View. It's another thing tear a man apart for no reason other than trying to feel bigger than him. Because in the end What is going to happend is going to Happend might as wellmake yourself useful.

I will Agree that DUI is Dangerous and even reckless But (Dumb)It's not my place to judge but if the Cap fit's where it.

Prosecutors (not courts) decide to file charges.

Public Defenders are DUI specialists...or some can be. All they do is criminal law. Some are better than others, just like the high price lawyers.
