NYS has 5 DUIs and you lose your license forever. Do DWAIs count the same?

I have a DUI- marijuana misdemeanor, What level do I have to pee to be over? I took 4 hits and wasn't even stoned but I can't do the balance tests anyway- 66 years old diabetes tremors, 6'4''. And that's the "test".

I can't afford a lawyer now, next year I can. Will they come after me in India/SE Asia? Will they cut off my $478/mo SS retirement payments? Will a warrant stop my travel from country to country? Will any of this be a felony here? Interesting eh what? Can I sue my brother the executor for absolutely refusing to do any estate planning, thus costing us each 100-300k? Contingency deal with lawyer?

If you are in India, there is little likelihood that you will be extradited to NYS on a misdemeanor failure to appear warrant.

I have no idea what your DUI has to do with estate planning.

Thank-you. That's why I have no money now...

Do you think they would cut off my SS retirement payments eek?

My research so far says they can't for misdemeanor...

If the estate planning is an entirely separate legal issue as it appears to be, you can start another thread to address any questions you have on estate planning. This forum just prefers that all RELATED questions are kept to a single thread.

To answer the original question, any alcohol or drug related offenses in any combination count. This counts DUI, DWAI, and the .08BAC convictions.

Drat. It's been 19 years since the last one...This little town. 3600 people, with town police, sheriffs, and troopers all headquartered here. Brutal. Hello, Uber!...

The "look back" period can be as much as 25 years in New York but it appears for your offenses (absent any extraordinary facts not yet disclosed), you would be subject to a 10 year look back period, as it concerns penalties and license suspensions. That said, with your history, Uber seems a smart alternative to driving again.

Why are you "hiding" by moving from country to country? Certainly it can't be to avoid the consequences of a misdemeanor, can it? Problems with your passport are caused by what?

Well THAT sounds good, since 2 are 26 years old and 1 is 37 years old. But another site says it's 5 in a LIFETIME. Jeez...scary.

And since this is a legal forum, I don't consider this nit-picking... NY has no DUI charge. It's DWI.
Wrong again. And I never had an accident while drinking nor any charge of speeding or anything else, and this town is nuts. You used to have to do something wrong when the greatest generation was in charge and not the nanny state. Whatever.

Yup, it could. The look back for 5 DUIs is a lifetime in NY, and maybe, I just want to skip the probation, rehab etc and go to a cheap country I can afford without being a state ward, where few people have cars and public transport is great. (What really pisses me off is if they had a real test for being stoned I'd have passed.) Say I stay there for 7 years and need a passport to remain, will the USA screw me on THAT? And I'll
have to come back for the probation THEN. So I guess I'll just relax and take it...lol arghhh

Sorry but I just went to the NYS DMV and that's the deal.
