The very first response you received answered your question. You're looking for a different answer-that answer ain't coming.

So, just in case you forgot, here it is again:

My response:

The old saying goes, "A fool and his money are soon parted." In your case, you're just an idiot.

YES> YOU CAN FILE A LAWSUIT. Do you know the person you are going to sue? Do you have an address? Do you live in the same state? What if the "seller" is in Nigeria? What if he's three states away from you? What if you get a judgement for eight billion dollars and the guy never shows up because he doesn't really exist? Try to keep a lid on your greed and wisen up. You got hosed. It happens. Move on. I'm serious.

Hello~I am sorry to hear that, and I am not here to bash you. I believe that you paid via paypal. Did you file a claim with them, or ebay? Usually, they are wonderful about refunding money.

Ebay also has a good dispute resolution center. Try them, they charge a $25.00 deductible. Did the seller respond to you? Is he even on ebay anymore? My future advice to you is always check the sellers feedback. If it is zero, or close to that, move on. Send me the auction number, so that I can take a look. Anyway, do not view his disclaimer as an obstacle, fraud is fraud. Especially since he taped that crap on a piece of paper, intending on defrauding you.

It is not your fault that you trusted this auction, and thought is was legit. Take him on judge Judy , so that she can humiliate him.

I have to say this is the biggest line of bullcrap I have heard! Did you ever think that if it was a so called mystery auction then why the hell would they tell him what he was going to recieve? He took the risk so yes, it is his fault and he has no one else to sue but himself for his stupidity.
