"Whatever the outcome, this seller is going to be left with the most slandering feedback in the history of feedback"

I'm a long time seller at Ebay, and know all of the ins and outs of buying and selling. I know how you can get your full amount refunded including shipping.

But, with your last comment, I'll keep that information to myself.

My experience has been that most sellers print their postage at Paypal. There's no chance for error, since the info used is automated, using your registered address. All of cases I've had like yours have occurred when a buyer moves and hasn't changed their shipping address at Paypal, so the package gets delivered to their old address. In your case, the item is worth over $250, so it must be signed for, and that's why it has not been delivered. Is this what happened?

It sounds to me like the seller, Fedex and Ebay are going out of their way to complete this transaction. I get difficult buyers like yourself every now and then.....that apparently expect me to spend $100,000 hiring a private jet and a taxi service to deliver their $300 item at their convenience. If you would, please tell what your ebay name is....so I can make sure I put you on my buyer blocking list

I don't know if you read the whole thread, but I explained in detail what happened, so I don't appreciate you assuming something else happened, and then criticizing me for your uninformed assumption. The reason I said what I did about the feedback is because the seller had been extremely difficult up until today. He has slandered me numerous times, and I've kept my mouth shut and tried to cooperate. Now I could lose $400 on top of all the verbal abuse I have taken from him thus far, and your going to tell me what I can or can't leave as feedback? Next time don't attack someone without knowing the full story.

No, I did not give him an old address. My current address is listed correctly on both my ebay and paypal accounts. What happened was somehow Fed Ex had the wrong APT# on their end. Whether it was the sellers fault or Fed Ex's is unknown. Fed Ex claimed it was his mistake, and he claimed it was their mistake.

At this point, they are not re-delivering because it exceeded the delivery attempts. They made 5 attempts, but 4 were to the wrong APT#. So I only got 1 actual attempt to my APT. I wouldn't call that going out of their way. And Ebay gave me a $10 courtesy coupon for a potential $400 loss. Yes, I appreciate it, but thats hardly going out of their way either.

So at this point the item is being held for pick up, but they won't release it to me because I don't have a valid photo ID. I lost my ID recently and I'm still waiting for the new card to arrive by mail. So they said the only option at this point is to send it back to the shipper. I undertsand that is my fault, but what else can I do at this point? They won't deliver it and won't let me pick it up, so it's being sent back. Just because I don't currently have a photo ID I lose my money? That doesn't seem fair.

My payment has already been released to him, so he will have both the item and funds, and I don't know if I'll ever see either again.

It turns out they are going to bill him for return shipping - $150 total there and back. The total I paid was $375 for the item and shipping. I would like to offer to take a partial refund of $200, and tell him he can use the remaining $150 to cover his shipping bill, and he can keep the $25 remaining for his troubles, and he'll obviously get his item back as well. He has been so adament about not giving a refund, that I'm afraid now that if I ask for even a partial refund, that he'll be so offended that he won't return my calls/emails anymore and I'll never hear from him again or get my money or item back.

I think thats being fair he gets his item back plus $25 for inconveniences. I'll be out $175, but I'll take $200 back over potentially nothing. He seems to think that I'm trying to avoid delivery to get a refund, but I certainly would not choose to lose half my money on return shipping over just keeping the item thats worth more than I even paid for it, and could be sold back for more.

If I were your seller, I would refund your money minus the shipping as you stated. It's the proper thing to do. But, I can't speak for them. Hopefully they are ethical.

I agree, it seems like the fair thing to do at this point. The item was sent back, and he should receive it today. I contacted ebay again, and they said to try to work it out with him before opening another case. I lost the first case, and the appeal. So I think I'm not going to be opening any more cases unless I cant resolve this with the seller. These cases don't seem to be working in my favor. So hopefully I can just resolve this with the seller. Thanks for the advice.

What's the exact date you purchased the item? Please post the outcome of your situation.
I purchased the item on 8/27/10. He received the item back on Friday, 9/24/10, and I haven't from him yet since he got the item back. I didn't try emailing him until today because I was still deciding what I wanted to say/offer, but here is the email I ended up sending:

"Hi, they said the item was sent back to you, and I wanted to know if you'd be willing to give a partial refund of $200. You could keep $150 to cover the shipping costs, and another $25 for the trouble. Please let me know if thats okay or what you want to do, thanks."

I'll post an update when I hear back from him. Hopefully, this will finally be resolved this week, and I'll post the outcome.

Lots of scammers on ebay (and paypal does not help the buyer with these folks) so I guess we'll find out about this one. I dont buy jack on ebay; scammed too many times.

I heard back from the seller and he refused my offer for a partial refund or full, and also refused to re-ship. He said if I want the item I'll have to pick it up at his store in Chicago.

Am I eligible for a refund under ebay's buyer protection program, where ebay will re-imburse me the money?

Or am I responsible for driving to Chicago to pick this item up?

Why don't you offer to send him the re-shipping cost IN ADVANCE?

I'm willing to pay for re-shipping, but based on his email he said he's not wasting any more of his time shipping the item again.

I think an alternative could be to have UPS/Fed Ex pick it up from his store for me and deliver it to me. I am going to ask if he will allow that.

I'm not going to send him more money though, I'll make payment arrangements with the carrier.

I contacted ebay again, and they said a case specialist will call me and tell me whether I can appeal my case again. I already appealed once and lost, but that was under the asumption that the item was en route to be delivered. Now that he has the item back and is refusing to re-ship, I may be able to open a new case.

I think ebay/paypal should have never releases the funds to him before I actually received the item. They released it to him on the premise that he provided a tracking number proving he shipped it, but unless I actually receive the what does that matter?

I thought the purpose of paypal was that they were acted as a middle-man and held the buyers funds until the buyer receives the item.

I might as well had just sent a money order and hoped that I got my item someday.

If sellers are allowed to keep items and the buyers money for items that get sent back by the carrier, ebay needs to have a boldface warning on their homepage stating that if you buy something and are not home receive it, then the seller gets to keep both the item and your money.

I'd like to see how many ppl would still be shopping on ebay if they knew this policy ahead of time. I know I wouldn't have shopped there, nor will I ever again.

Well, I spoke with ebay and they said there's nothing they can do as far as giving a refund.

So I'm going to schedule to have UPS pick up the item for me from his store. That should be the end of this case, assuming he cooperates and has it ready to be picked up, and that the item hasnt been damaged through all of this shipping.

But I'm optimistic that I'll get the item in the original described condition, and I'll post a final update once I get it. Thanks for all the advice along the way.

I've followed what you've done, and it is unreasonable for the seller to not refund you $200.

Although Ebay owns Paypal, if you want all your money back including shipping, you must file at Paypal, and not Ebay. You have 45 days from the date of purchase. You are on day 36 from the date of this posting. At Paypal, the seller must prove you received the item by signature. They cannot provide this. Good luck.
