Isn't the whole idea of ebay and other auction sites is to make money. The guy buys low and sells high, thats business. However he will still have to sue in your state. If you have not gotten served yet and have no idea what is going to be in the papers if you do why are you so worried about it?

you are right. really shouldnt worry about it.. its crazy though.. thanks for everyones help. i will let you know the outcome..
