Not illegal but unprofessional

Not trying to attack anyone here, it seems to me as it might no be illegal, but certainly unprofessional.

Further more, its my understanding, that what is know as TRUST Counselors, should act in the same manner as a psychologist would, not allowed to divulge information to third parties.

At the same time, if my kids were doing drugs, and I didn't know about it, I would like them to let me know.

1006.09 Duties of school principal relating to student discipline and school safety.--

(8) The school principal shall require all school personnel to report to the principal or principal's designee any suspected unlawful use, possession, or sale by a student of any controlled substance, as defined in s. 893.02; any counterfeit controlled substance, as defined in s. 831.31; any alcoholic beverage, as defined in s. 561.01(4); or model glue. School personnel are exempt from civil liability when reporting in good faith to the proper school authority such suspected unlawful use, possession, or sale by a student. Only a principal or principal's designee is authorized to contact a parent or legal guardian of a student regarding this situation. Reports made and verified under this subsection shall be forwarded to an appropriate agency. The principal or principal's designee shall timely notify the student's parent that a verified report made under this subsection with respect to the student has been made and forwarded.

(9) A school principal or a school employee designated by the principal, if she or he has reasonable suspicion that a prohibited or illegally possessed substance or object is contained within a student's locker or other storage area, may search the locker or storage area. The district school board shall require and each school principal shall cause to be posted in each public K-12 school, in a place readily seen by students, a notice stating that a student's locker or other storage area is subject to search, upon reasonable suspicion, for prohibited or illegally possessed substances or objects. This subsection does not prohibit the use of metal detectors or specially trained animals in the course of a search for illegally possessed substances or objects.

see what makes me upset, is the school never notified me at all. but the case was closed on my daughter because she dont use drugs. but on my case with the school we are going to court.

Oh one more thing there are laws out there that protect you and your families privacy.

So many issues....

One: I think all of you have strayed off the subject of law to personal vendetta's against one another.

Two: I forget who it is that said "the school has many more rights than your daughter." Well, I'm not sure how to say this, besides HORSE****. A citizen is gaurenteed rights, including those to not incriminate yourself. All juviniles have the right to have parents present before all questioning, regardless of whether it's coming from the school or the police. The United States Supreme Court is quoted saying "Students shed no rights at the school gates". Also, the school is an institution, institutions do not stand in any special category above citizens, including juviniles as they are citizens too. The public education system is straying away from it's real purpose, serving the students, any more the students are serving the school's own strayed views and desires.

Three: Asking a student anything about his/her family is not only illegal, however more importantly it is immoral. Nobody should ever be induced to answer questions like that by the school.

Four: Students should be protected while in school, not pulled out of class, removing them from their education, and harassing them about drugs and family issues that are private.

Five: A "Drug Counselor" is not one whom needs to be sucking up the school's money and/or time, especially during school hourse involving students who should be in class.

Six: Hypothetically the kid's parents are using drugs, then what? Pull them out of their parents home? Surely not. Surely you wouldn't juist rip a child away from his/her home because she said one sentence to her school?

Seven: Hypothetically the kid uses drugs, then what? Prosecute? Discipline? Illegal search? I surely hope not.

Finally: I'm 17, I have seen first hand recently how ridiculous, blatantly illegal and immoral the public education system has recently become. It's spiraling downhill and it's moving quickly. "frivilous lawsuits" are what gaurentees our freedoms. The parents in this case need to sue, and they need to ride it out as long and as rough as possible raining down hellstorms on those who have violated their child's rights in school, and if nothing comes of it, make it as public as possible, take to reporters write in letters to the editor, post it on websites, notify the local, state, and federal board's of education, tell the story loud and tell the story often, good luck with it all.

You know after reading all the post that I have read in the past pertaining to my post,all I wanted is some reasurance,some one to say ,,yes your right,,or they cant do that,,, or if I was you I would have went to the press ect,, I do have a lawyer and we are taking this to court, its not about the money, its about your rights , about how you feel as a person ,a parent and a mother when your are questioned about your parenting ,Its truely hurts,, I know I will get some kind of closure when this is all over with, I could not believe no one,,,on one!!!!! got what I was saying ,I went to the school board I went to the school I spoke to the people at the drug rehab place I spoke to at least 15 people there.(everyone was covering up what they have done) and even the people on this post, No one got it.

But you.your the only one ,,(besides my lawyer) I feel like about 50lbs has been lifted, when I read your post ,I said to myself see I knew someone would know, someone knows how I feel ,I knew someone would read it and they would just know how I feel ,you have a lot of wisdom at 17 Thank you from the bottom of my heart ,,,tccleaning1

Straying off the subject slightly...

TC, your welcome, I see where your coming from and agree.

Stealth, I see that your a pompous and self-loathing person however I'm not here to judge you, however if you wouldn't mind entertaining me, cite your reasoning to claiming i needed to stay in school longer, please educate me, seriously. I got a 1440 on my SAT's and was tests in the top 1/2% of the nation on a school IQ test in 3rd, 6th, 9th and 12th grade. I have a full scholarship for eight years to go to law school. More importantly though, I'd love to hear from your mind, from your brilliance as you seem to feel confident you posess. Share your brilliance and enlighten me Stealth, truly, enlighten me, you might surprise me and bring up a point I value.

Your perceptions of the law, while wonderfully idealistic, are well off the mark of reality. In addition, your grammatical skills, while significantly better than those of many of your peers, need quite a bit of polishing. Stay in school.

Stealth, if you would prefer me to take the extra time to put great detail into respectin gramatical standards instead of simply posting, I shall do that. I do not hover over my computer watching every key I have pressed. I simply type and things like "typos" occur. I do not feel I am writing a doctorate by any means and due to that, I do not write as such. I am sure if I pulled up your past posts that I could find scores of gramatical errors in your posting. This is a petty subject to disagree on, although I repsect your views.

Also, for your personal knowledge, I am going to law school and therefor am staying in school, nor have I ever claimed to have a degree in law yet. Also I assume that you have not done so either. Law comes from the roots of ideology, what is fair and right. You will find that in most circumstances, what is fair and right is also legal. Plus, I have studied many legal books, notes, cases and such and feel that I have a basic understanding of the issues, specifically Education Law. Thanks for responding to my post Stealth.
