OP, six five-minute smoke breaks don't count as one 30-minute break. The legally-required 30 minutes must be continuous.

Heartily agree with cbg. If this person doesn't know what Worker's Comp is, he has no business starting a company with employees, needs serious guidance. OP needs to contact the state's Department of Labor, Employer Assistance/guidance, and they will help him get legal in no time. They have specific guides for employers in each state.
