Thanks for answers and Ill try what was suggested. I wanted to ask, since a judge can only evict someone? Would it be 30 day eviction notice if he goes through the court or what? How would that work? We are looking for a new place. I wonder if I could get my deposit back from him but it was only $250. Someone told me I could done constructive eviction with no heat but then we ran late on rent due to high electric bill (for past two months it has been high) since using electric space heaters throughout the two bedroom house so he sent that email saying it serves as mandatory eviction by the end of december.

Did you keep a copy of the letter you sent the LL citing the Laws ?
Do you have the rent amount put up , or available if or when you go to court ?
I think if you can prove to a Judge what you have done , the judge would be sympathetic to your needs .
If it goes to court make sure you cite the laws you sent the LL , and where it says you're allowed to withhold rent , or use it for repairs .
You really need someone to get the LL to get heat in there .
As I stated , you could use constructive eviction , but in order to do that you have to move, then sue the LL .
