Problem is, she sends me theses msgs from his email address. I know it is get by the wording. I have already Todd him to have her stop but he does not care. I don't know what legal action i could possibly usage against get....

Stick to the court order, when you know he is not going to pick up the kids from school, you show up. Don't allow GF to take the kids. If he wants the kids during his parenting time, after you have picked them up, he can come get them when he does become available.

You might also look to modify the order to include some kind of non-intrustion clause. Email your ex and let him know that you will no longer tolerate her involvement in your legal matters and if she continues you will take him back to court. When his current thing gets the email, she will fly off the handle, save that communication as proof of her intrusion. File to modify.

If you don't stop her now, you'll look as if you are okay with her intrusion.

It looks like the crux of this is going to be requesting some stipulation in the court order that father notify you when he has his work schedule. If its a set schedule...each month at the beginning.

You will have to convince the court, dates, times, etc., that you know dad was working and that he refuses to exercise the ROFR. If you can convince the court of that...perhaps you can convince the court to ORDER dad to provide his work schedule to you...just as he does his gf.

BTW...if you CAN prove dad consistantly refusing to exercise the ROFR - or the clause you posted in your court order, you can also file for contempt of the court order.

She gets out of work before me and picks the kids up before i get there. I have tried removing her from the parentbpick up but the school says since dad allows her then theres nothing they can do. After she picks them up i have no clue where she brings them. I have told him numerous times to tell her to mind her business. He does not care though. Were already in the process of modifying the custody order.

That email will be proof that dad isn't there since he is asking for the GIRLFRIEND to act in his stead. USE it.
