I am wondering if there is anything I can do about the harrassment that my ex is bringing on me!! First off....she received a $500 check from my insurance company that was made out to me, it was sent to her address by mistake. Instead of forwarding the check to me or the orthodontist where it was suppose to go.....she forged my name in what looked like my handwriting and signed hers under it to make it look like I had signed it over to her. Well after alot of time and accusations directed towards me from the orthodontist because she kept telling them that I had the money. The insurance company fraud investigators found out that she had forged the check and deposited the money into her own account. Now...the insurance company automatically took the money back out of her account and she is calling me telling me that I need to pay her back the money!!!! She even went as far as to say that the orthodontist has refused to take off my sons braces next monday until we pay her that money back. Of course when I contacted the ortho they told me that she decided that she was going to hold this over my head and tell me that I am making my son suffer so I better pay her back!! No way in this world am I going to pay for something that she did illegally!! I guess what I am asking is....how do I stop this harrassment and is there anything I can do legally to stop this game she is playing. Not to mention that she said last night on a voicemail that she is not going to meet me halfway to bring my son for visitation until I pay her back....she lives 5 hours away in Minnesota. If there is something I can do, who can I contact about this?

Is there a Court Order for visitation???????? If there is then she has to abide by the order (meeting you half way). If she does not you can get her for contempt of court. As far as the harrassment a Restraining Order is all that I can think of and there are many rules that she would have to follow if you started one of them. Surely if you got a RO then she would back off, but if not then she would get in trouble.

Does your court order address meeting 1/2 way for visitation? If so, save that voicemail message! Contact the police and request a report be made- EVERY SINGLe TIME she does that...Then file for contempt. If not, you're going to have to drive to pick up your son unless/until you file for a modification to include 1/2 way meeting place for visitation.

What you describe re; the insurance company is a bit 'off'....ie; if they removed the money from her account (realizing she fraudulently cashed it) they should be re-issuing the check to you. Have you spoken with anyone at the insurance company re; this?

She can tell you to pay her whatever she wants- but you don't have to do it, because you don't owe it to her. tell her to take you to small claims court :D They'd have a heyday with her. :cool:

Yes the orthodontist is all paid up. I paid my half as soon as the braces were put on.Even before the insurance was all paid. The first check that came from the insurance was given to them. The next check was the one she kept. She kept the check in Jan. 2004 and she just finally paid the orthodontist off that $500 about a month ago. Its because the insurance company found out that she had kept the check that she had the $500 taken out of her account automatically. I am totally paid up on my end and have been for a long time. I have absolutely nothing to do with any of this and can't understand why she is telling me that I owe her money at all. She is just pissed that she got caught!!

Yes our court order states that we meet halfway. And yes I did save the voicemail...I have to keep everything when it comes to dealing with her. I can't believe a word that comes out of her mouth!!
I will talk to the insurance company to see about the re-issuing of a check. What do I do with the money if they do send it to me if the insurance company is all paid up? This is getting crazier by the minute!!

Then she is just pissed & wants money from you...ignore her and follow the court order re; visitation.

Did the insurance company ever re-issue the check to the orthodontist? If the orthodontist is paid up, why won't they remove your child's braces? :confused:

They are all paid up. When they found out that she had kept the insurance check they told her that she had a certain amount of time to pay them back....they told me that she finally got them paid off last month. I think that is why the insurance company took their money back out of her account.

Give it to the orthodontist- Then the orthodontist will refund the mom the $500 she paid them in lieu of the check. Sounds like she had to pay the $500 because it was owed to the orthodontist- and the check wasn't re-issued yet. So, she is out the $500 <karma? :D > and so she's thinking (incorrectly) that you should give it to her and then wait for the re-issue to be sent to you.
Call the insurance company & find out what's what.

Drive the 1/2 way to visitation and if/when she is not there- contact police and file a report. Play the voicemail for them. File in court for contempt re; the denial of visitation.

Sometimes they only warn for first time contempt- but I sure hope they at least give her a good tongue lashing! :D

Ok...let me understand this. She fraudulently cashed the check, but eventually DID pay the 500.00 to the orthodontist?

THEN the insurance company took the money out of her account? At that point the insurance company is going to reissue the check to you.

So yes, you DO owe her the money if the insurance company pays you. She paid the orthodontist 500.00 that she didn't owe. Either that, or you still have to pay the money to the orthodontist and the orthodontist will owe her a refund.

Either way though...that 500.0 is due back to her.

The mother cashed the check but did NOT pay the ortho.
The ins. co. investigated then removed the $500 from her account.
THEN the mother made payments until she finally paid the ortho the balance of $500.
Dad was paid up from the get-go...isn't owing the ortho or the mother.
It's now up to the ins. co to re-issue the $500 check. That will be sent to the ortho, who will then have to refund Mom the $500...OR it will be sent to Dad, who will give it to the ortho & then the ortho will refund mom.

To the OP: DO NOT GIVE THE CHECK TO THE MOTHER if the ins. co. sends it to you- give it to the ortho. Mother already tried to fraudulently imply you gave her the $ instead of the ortho. The ins. check is for the ortho- give it to them & let them handle Mom.

Thank you casa...that is what I will do. You understood my post exactly and there is no way in heck that I would ever give her the check!!
 
will she be presecuted for forging your name? Just curious if they can since they were able to retrieve this money.
