CCRs and HOA Rules

My CCRs allow for the HOA to create or change any rules as they vote appropriate. You may want to read your CCRs and if this is the case you can run for a spot on the BOD of the HOA and make the rules which will require him to change (with the support of other members). Keep in mind that from what I understand, if the HOA changes the rules, he will be required under he CCRs to comply, regardless of how long his home has been that way.

Hey, I live in Missouri want to trade houses? Your neighbors sound a whole lot better then mine. I live in Missouri next to Kansas.Split foyer, three bedroom, basement, A big lot with a big willow tree, but you would have to cut it down though, because our neighbor complains to our kids that they don't like it.I have a bush also that has real pretty flowers on it in the spring, but you will have to cut that down too, because it's right next to the property line on our side and the neighbors hate it because it has thorns.

Have you thought of going over to talk to the guy? Tell him you understand his need to do landscaping and suggest he gets some professional advice to help him know what to do. Most landscapers I know will do a diagram for free and they he'll see what needs to go where (and what needs to be removed).

If this is impossible, or ineffectual, then I, personally, would continue to complain and be heard, both with the city and my HOA (your HOA fees should cover this type of complaint). Arm yourself with plenty of pictures. I'd complain until I was blue in the face. Insist they make this guy comply to correct the violations.
