What is the name of your state? Kentucky
My Mother passed away with no will. She has five children. She owned property which went to us five children. Everyone has agreed to sign the property over to one of the children. Can the executor sign it over by himself or do all five children have to sign it over? And do we have have a lawyer draw up the deed or can we do that ourselves?

Confused

I do not know the laws in Kentucky, but it would seem if real property was involved you have to go to probate court. If your mother died intestate without a will, then how can you have an executor. Unless you have been to probate court and they appointed one? If that is true, then the probate court should be able to give you direction, or use the attorney that went to probate court on your behalf to handle the transfer.
