OK , now you've entered a New Ball game .

There's a couple of confusing things though .

Did you both move to FL. at the same time w/ the children , or separately ?

Fill us in , with the time frames .

Secondly you said a Judge ordered her to stay put with the children in FL. until this could be heard but she fled back to NY w/ them .
Then the Judge said he couldn't do anything for lack of Jurisdiction.

If the children and her were only in FL. a short while , and they went back to NY ( where the Orders were made ) , then NY would retain Jurisdiction .

She can not then be charged with joint custody kidnapping , since you moved to FL. and remain there , and she wasn't gone from NY for long .

Yes , you will have to let a Lawyer in NY speak for you .

We both moved to Fl 3yrs ago with both children.

After a year we seperated she took off with the kids to Ny for a whole year she wouldn't let me see my kids only 3times in that year. She said because I was with someone else she wouldn't let me see my kids. Even though I was going by myself. I talked to my kids all the time though. Well then we filed for divorce and all the paperwork was filed in Ny since we were married in NY

Yes he said that but the kids were living with me for 9months and with proof they were already residents of Fl. She told them that I kidnapped my kids but she notirized a letter stating they were living with me and this was in April my son was in school since Aug

The children were in Fl from April04-Dec04 living with me and she was living in NY

The lawyer said she can be charged with something considering she took the kids and didn't notify me and now she won't provide a phone # or address so the lawyer said she is because i am supposed to call my kids and have their address noted in por paperwork she said she'll discuss with me more once i send my retainer fee so we'll see what happens
