What is the name of your state? TX What can I do. I live in TX with my 3 children and their step-mother. I have joint custody and am the custodial parent. The childrens mother has visitation but has not seen or attempted to visit them since Summer 2000. On July 27, 2004 She popped up unannounced and took the kids with her. I did not her from her until after I placed a missing persons report with the police, The police say that since this is their mother and the kids are safe that it is a civil matter. I feel that this could of been handled better on the mothers part. If she would of contacted me she could of gotten them also. Children are 11, 14, 16.

How long was she supposed to have the kids? If she's not returning them as she's supposed to in the order, then file against her for contempt.

The kids are with their mother I beleive going to Iowa. Dont believe the are coming back. Legal question is what can I do in regards to how she took them. Her legal visitation was suppose to be 6 weeks during summer. School starts in 2 weeks. So based on when she got them and how I believe she wants to keep them.

What dates to dates in the summer , any specified . Was she to notify you first ?

Wait until the specified time is up . If they are suppose to be returned before school and they are not ,file Contempt charges against her .

Do you have Joint Custody ?

Okay, but you don't know that. Does she know when school starts? What sort of notice was she to provide for taking the visitation? Were there specific dates?

Come on, man - give us some information to work with. Yeah, you're upset, but shorting out your keyboard with tears and depression isn't going to help your situation.

Who let the children go with her? How did she just pick them up?

What does the court order specifically say regarding visitation. Is she supposed to give you notice of her intent to visit? Picking up the children on the 27th does not give her the alotted 6 week time. I suggest you contact an attorney now. I don't suggest waiting around for two weeks waiting to see if the mother will return the children. You may not be able to file contempt charges until school starts, but at least the motion will be ready for filing.

If the child(ren) are not returned by the specified date , you can file a Criminal charge. If she removes them from the State with the intent to keep them ,Custodial Interference is a Felony Crime .

Most local police won't get involved , but you have a right to file after the date they were suppose to be returned .

There is also Missing and Exploited Children. Also ask this agency for the number for your State's Clearing house for a copy on Family Abduction. It has a wealth of information.

I was Just reading after the Limburg Abduction Child Find Of America was started. That's the agency I used . I wasn't aware of the Laws back then .

Huh... Wouldn't have expected cheese to be involved. You don't by chance mean the "Lindhberg" abduction, do you?

Plus , I'm a humorous type a guy anyways , and poking can be fun anyways :)

I did go back into search . A Limburg ( Cheese ? ) did get arrested for abduction LOL

And what about Rush ? Musta been those muscle relaxers .. : )

The divorce decree states that she gets visitation for 6 weeks in the summer. starting 2 weeks after school gets out. She is to make arrangements and pay for travel. School gets out most of the time before June 1st.
