Is it legal for a franchisee to give different independent franchises different pricing on products? and that pricing could effect other franchises not being able to compete with that price.

Generally yes, it would be legal for different franchisees to be given different prices. These sorts of things are commonplace -- cheaper prices for volume orders, cheaper prices of longevity, etc.

what if the volume, time ect were the same?

lets say I make an order for 5000 pieces for 6 months
another franchise makes the same order but gets it at half the price.

Unless there is something in your franchise agreement that says every franchise has to get the same price, there doesn't appear to be anything illegal happening. You could always take you contracts and agreements down to a local lawyer, who can review all of the facts of your situation and advise you accordingly.
