garage remote

What is the name of your state? CA

My apartment complex has put in new garage doors. My old remote has not worked for some time. Since the flyer they sent around said "Please come to the office to pick up your remote by 5:30 pm the day your garage is intalled" I thought I could toss the old one since it did not mention you had to turn it in to get the new one.
The lease does say AT MOVE OUT you must turn in all keys and I.D. cards or there will be a charge. It does not mention a garage remote. They want to charge $25.00 for the old remote and won't give me the new one until I pay.
Can they do this? I am NOT MOVING OUT, they decided to put in new doors.
Please advise ASAP..thank you very, very much.

can they charge you for the remote? yes. you disposed of the LL's property.

can they withhold the new remotes? if your lease entitles you to access to the parking garage and a clicker is required, then probably not.

but one of two things will probably happen when you insist on a new clicker without paying for or returning the old one: either a pay-or-quit notice for damages incurred to the LL's property, or a perform-or-quit notice for the return of your clicker. either one can lead to an eviction if you don't respond to their satisfaction.

Yes they can do that. A garage remote would fall under the catagory of "all keys".

I am really really sorry here. But look around this forum and realize that $25.00 is nothing. OKAY!.. that is a persons 4 day addiction to that coffee place that everyone hears about.

WHY, WHY, oh WHY............

would you throw something away that's not yours????? No matter how useless YOU may perceive it to be (probably just needed a new battery.) It wasn't yours to throw away in the first, second or last place. (And there are people (I have an EXCELLENT handy man) who can fix stuff like that!)

I just had a tenant throw away 2 cold air return vents. They looked gross, granted. But guess what...........? They are odd sizes that are not made anymore. They needed to be cleaned up and repainted. Now they're complaining to me about the openings in the wall. Sorry, Charlie...........you can bet that I'm not doing anything about it until they move out, and YES it will come out of their deposit!

I digress............it's been a rough morning.

a *-or-quit notice is not an eviction, just a notice that you CAN be evicted for whatever the deficiency is. beythey also have another option: when you move out, deduct it from your security deposit.

Twenty-five dollars is a lot to some people, consider yourself lucky if it's pocket change to you.


To the other replies with smart ass comments...you're more useless than the broken remote. :D
