garnishing wages

My husband just recieved a call last night from a credit card company that we have been in dipute with for almost a year. His card was stolen and we were told we were not liable for the charges, we filled out all the nessessary paperwork and filed a police report. A few months later they stuck some charges on his account that were made by the woman who stole his card....they deny this but we have the proof in our statements...Well anyway the man who called said that he would be contacting my husbands place of employment to garnish wages this week. Can they do this without taking us to court first? Can they simply call and say give us his money?

SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.)

thanks so much for your help I just finished checking the credit reports. The credit card company has not filed a negative report. The account is listed in good standing and pays as agreed on all agencies. So I guess I will just keep disputing the credit card company.
