What is the name of your state?Texas

Ok, so I have credit card debt and haven't paid on it in over a year and a half. I owe $5000 to one credit card. I was planning on filing bankruptcy in the spring when i have money for a lawyer to handle it. Anyhow, I got served today w/a suit from the credit card company asking for me to respond and i don't they will ask the court to find a dfault judgement against me. So, what happens if I just don't respond? I'm thinking they will get a judgement and attorney's fees from me, but like I said I am already going to file bankruptcy on these things so not sure what or if anything will happen to me. So, if anyone has a clue or an idea please let me know. I don't want to make a wrong decision, but at the same time I don't want to give into to these credit card hound dog's!

No, but the reasons why my credit cards were maxed out were because of an emergency situation w/my health.

Ok, I came to ask a legitimate question, not to be judged for any reason at all. I will be reporting your smart ass remark to the admins here and go elsewhere for any advice and be sure to tell everyone i know not to come here.

My response:

It was educational. You may not think so, but that's beside the point. It teaches people who read this thread that we don't help cheats, thieves, and deadbeats.

So, take your lumps in court.

Will the Judge send the person to Debtors Prison? That makes sense if he was in fact "stealing". Since they don't have debtors prisons anymore, I'm guessing that means people who fall behind on their debt are not cheats or theives in the eyes of the law. In fact, I think the cheats may be the credit card companies with practices that would put the Mafia to shame.

My advice for the credit card companies and IAAL - stop lending money to "cheats"!

If default judgement is found in favor of the Plaintiff, said defendent can have any of the following actions taken upon them. Liens, garnishment of wages, sheriff auctions of property deemed valueable to offset the sums due. See your state for what is permissable once judgement has been granted.
My advice- answer the summons, and appear. And cut IAAL a break, he so often answers legal questions in an informative manner, Consider his response one of his off moments. He really is a well educated gentleman and an asset to this forum.

Really?

Then don't apply for, and accept the terms and conditions of, the credit in the first place. Credit card companies are not your personal cash cow.

Couldn't agree more! One mistake I'll NEVER make again!!!! Especially when they mail new terms and conditions out every month. I AM NOT the credit card companies personal cash cow! And - if they want to be paid back - maybe they should stop out-sourcing jobs to low wage countries when the people who could be paying them back with money from those jobs are here in the U.S. The credit card companies are nothing but two-bit hustlers in my opinion and I was an easy mark!

People don't choose this situation

I am convinced most people get into a mess with credit cards by stupidity or bad luck. They don't apply for credit cards with the intent to run away and not pay them back. In my own case, I made things worse by not declaring bankruptcy about 3 years ago. I was so convinced things would turn around and I could pull myself out of this mess that I went further in debt to tide me over until I could find a better job that would allow me to fix my financial situation. I felt horrible when I finally went completly under. It was a huge blow. However, after talking to the collection agencies and telling them my circumstances, any shame I had has turned to anger. I have been insulted beyond belief. American Express has been extremely nice, but CitiBank has been ruthless. Their reasoning. I have never made a late payment in over 10 years, so I must have money stashed away. I am completely broke. If I had money I would pay. The way they have treated me is so awful, I don't care if they ever see a dime for me. Maybe that is why the poster called these people "Hounds" - they remove any feelings of goodwill you would ever have for them with their harassing calls and constant insults.
