However, after talking to the collection agencies and telling them my circumstances, any shame I had has turned to anger.
Absolutely! God damn credit card agencies demanding their money. The nerve!

I have been insulted beyond belief.
I believe that is a result of not paying your bills.

American Express has been extremely nice, but CitiBank has been ruthless.
Sounds reasonable.

for them to act this way. You catch more flies with honey. Not that you'd know anything about that. Maybe you should try it sometime. However, my lawyer told me to turn off my phone. He said those people are despicable and not to be trusted. Thank God he isn't as much of a jerk as the people on this board. Bankruptcy laws are there to give good people a fresh start. I have NOT committed a crime. Why don't they call US Airways and harrass them? Or Trump Casinos? Or Enron?

Please refrain from highjacking the original posters request for advice. If you have direct valuable advice for such person feel free to state such, otherwise start your own posts. You seem to be very opinionated.

I thought I was defending the original poster (and me and others in a similar situation) from the attacks from IAAL and John. As I see it, so far you have been the only one who actually gave the poster advice. I AM sorry and I'll log off.

First of all, being insulted in ANY fashion by a debt collector is AGAINST THE LAW !! Please go read the Fair Debt Collections Practices Act (FDCPA) found at www.ftc.gov. Verbal abuse, threats, and a raft of other things are NOT ALLOWED, but scumbag collection agencies will do it anyway. You must assert your rights to shut them up - you can even sue them for their bad behaviour and breaking the law. Unfortunately, original creditors, in most states, are not bound by the FDCPA - too bad they're not, they can be VERY abusive -which IS a stupid tactic to use - all it does is make people shut down - not open up their wallets. In some states though, such as CA and TX, the creditor IS held to a state version of FDCPA and they CAN be sued for their bad behavior.

There is no wage garnishment in Texas but, they can attach your bank account if they find it or, force you to give them the banking info.
Your options would be if you want to try and fight the lawsuit and try and stall for time to file bk or, try and file bk earlier. If they get a judgment, be sure the lawyer you retain knows that and will vacate the judgment for you post bk.
