Grandmother Took My Son HELP PLEASE!!!

My ex-boyfriends mother has guardianship of my son. Now i am no longer with my boyfriend who is facing criminal charges for a&b against me twice (its worse than that .. involving a weapon and murder threats) and also does drugs in the house where my son is, the grandmother also drinks a lot. im now trying to get the guardianship order vacated and custody given to me. i have a job and a place to live, no drug or alcohol problems and i`m his mother. what chance do i have???? PLEASE HELP

LONG STORY, i thought i was signing over for temporary. and she tricked me into signing a permanent one 90 days before its supposed to even be looked at or used or even SIGNED for that matter. i believe it to be illegal but im not sure. i never thought this would happen and i want my baby back!!

There has to be more to it than that. What was the reason you signed over guardianship to someone else, let alone the mother of this man who beat you? There is all sorts of help out there for battered women without giving up your child.
 
i didnt think i was fit at the time and wanted the best for my son and my ex was also not beating me at the time. this all happened within the course of one year.

I agree with rmet....there has to be more to this. OP you need to tell the whole story in order to get the advice you need!

i was 17 when i had my son. i had no job. nothing. i couldnt support myself. (when i was pregnant i had a job and so forth but had so many problems during pregnancy ended up losing my job.) i know i couldnt give my son the life he wanted right that second and i wasnted him to have everything. so i let someone do it who could until i got on my feet. then my ex started hurting me and threatening me and i had him arrested twice. now his mother will not allow me to see my son. its been 3 weeks and i feel like im dying. im fighting and i have a court date next thursday. how can i prove i'm fit to have my son now and give the court a reason to vacate the guardianship order?????

You were still a child when you had your son, what about your family?
Did you establish paternity? how old was the father?
Did you ask for child support from the baby's father or apply for welfare if you were unable to work? Did you talk to a social worker or battered women's counselor?
What made you unfit?

my family hated me at the time. no i didnt establish paternity??? i know hes the father. the father was 16. no, the father was also unemployed. no i didnt talk to a batter woman's councelor. i didnt know my rights or options. i just need to know what to do, im scared.
and i miss my son.

You were 17 when you signed the guardianship paper? I don't think you can be held to that because you were a minor at the time.....BUT! I could be wrong! Let's see what others think.

trust me i qualify lol i make 200 a week after taxes. no i dont have an attorney. i am supposed to go to boston with my mom tomorrow to get one appointed to me.

do i have a chance at this considering i never LOST custody. I dont have any reason to NOT have custody and dont they favor the mother??????

One would think!! What I know, mostly from this site, is that they do favor the parents.....unless they are a danger to the child, and from what you have posted that is not the case with you!! Please stick around...I am sure that someone with more knowledge will let you know!!
