One would think!! What I know, mostly from this site, is that they do favor the parents.....unless they are a danger to the child, and from what you have posted that is not the case with you!! Please stick around...I am sure that someone with more knowledge will let you know!!
Good luck....I will say a prayer for you!

Good that you have your mother's support now and soon will have an attorney. Also be sure to get the police reports about any abuse you suffered and declarations of witneses.

i have the second police report. not the first. does it matter how long ago it was in order to obtain it? I have a witness to the second offense, not the first, will this help? also, my ex violated the restraining order against him yesterday which also violated his release terms from court from when he was arrained from the second arrest. whats going to happen to him? will this help my case even though im not fighting for custody against him? his mother also has recently threatened to kill me on 1 occasion.

NO...go to the police dept that responded to the assault. They will give you a copy.

I have a witness to the second offense, not the first, will this help? Yes....bring the wittness....it can't hurt!

What happened withthe first offense? Was he arrested? Did you follow through with the charges?...

also, my ex violated the restraining order against him yesterday which also violated his release terms from court from when he was arrained from the second arrest. whats going to happen to him?

Can't say.....anything from a slap on the wrist to jail time!
will this help my case even though im not fighting for custody against him? his mother also has recently threatened to kill me on 1 occasion.

Did you call the police and report this threat?? Is there a report?

Get a copy of the report and bring it with you!! When you talk to your attorney bring all this up and give them the reports....S/He will know what will help you the most.....By the way....do you have a bedroom all set for Cameron? Make sure you do and bring photos!! You want the judge to know that you are prepared for the baby, and have everything he will need!! And dress NICE for court....professionally!! Dark skirt...not too short! and a nice top...NO tanks! Sorry if I sound like your mother.

i have a decent outfit. no, i do not have a room set for cameron. will that really help? do court appointed lawyers really help you out? (im sure its better than pro se - im sure ANYTHING is better than that) and yes, u sound EXACTLY like my mother- she said the same thing regarding the outfit. but its okay my mom is one of the smartest people i've ever known so i'd say thats a good thing to sound like her. haha.

What are my chances at winning this case?

How old are you?
I thought your mom was taking you to get an attorney?
Yes, you will need to show that you can take care of your child.
Did you expect grandma to give you everything she bought for the baby?

LONG STORY, i thought i was signing over for temporary. and she tricked me into signing a permanent one 90 days before its supposed to even be looked at or used or even SIGNED for that matter. i believe it to be illegal but im not sure. i never thought this would happen and i want my baby back!!

You will HAVE TO hire a Family Law Attorney or , Maybe a Pro Bono , or sliding scale fee , or possibly IF your State Allows it , a request for appointment as a " Poor Person " .. WE can not wade through the history or advise you Pro Se .

Good Luck ...

i now found out that the hearing is too early to have one on that date (an attorney). how bad will it rip me apart to go pro-se?
and NO i do NOT expect ANYTHING from that witch. I have things for my son already and I dont need her help whatsoever; nor want it.

Honey, any chance you can grow up by like 10 years and get a better education by the time court rolls around?
You have got to get your sh!t together! :(
I'm not trying to be mean, but you seem so immature.
You need to sit down and make a list of all you need to get and do to make a home for the kiddo, then, you need to do it.

he is 15 months. the grandmother has had him since february of 2005. I signed a paper her attorney made up and went in front of a judge.
