In reply to the entrapment. You are right it is not entrapment. However, I know you cannot just video tape people after they have asked you to stop. Second, closing the door wouldn't have helped much as the car windows weren't tinted.
So you were in public. Yes you can be videotaped while in public without your permission.

I was strapping my son in and he had it in my face paparazzi style.
You were strapping HIS son in. You were in public. He is allowed to videotape.

Either way I don't care about the stupid tape. It's just the lack of respect that got me.
Are you respectful to him? Disrespect does NOT mean illegal.

My son is having surgery tomorrow so it's off to bed for me. :p
Did you inform dad about his son's surgery? If you have joint legal custody did you get dad's input?
 


It is NOT entrapment. You also had notice that he was taping. You also had NOTICE that he was taping as you could see the video camera.

Yes you are supposed to properly notify father of the hearing.


Until it is cancelled it is still on the calendar. You filing an ex parte does NOT change that.
OG, California is a 2 party state. If a party objects to being taped, the other party must stop or it is illegal taping. Father could get into big trouble if he plays the tape in court and the judge hears OP repeatedly say she did not want to be taped.

OP, consider about suggesting in court email correspondence. That way you DO have a paper trail, plus it takes a lot of sting out of communications.

WRONG. It is a 2 party state for NOTICE. She was on notice that taping was happening as she saw the camera. ALSO she was IN PUBLIC. She was not in her house. There is NO EXPECTATION OF PRIVACY in a public place.

You are right birdbrain53. My attorney called me back finally. MichaCA, I have been e-mailing him for at least a year due to him being so argumentative and demeaning. Thanks you two for a little encouragement! ;) Ohiogal, as I notice at the bottom of your posts you practice law in OHIO. As far as being respectful, yes, I always treat others with the same respect I expect for myself. In regards to my son's surgery, I have e-mailed the father many times reminding him of the dates and the doctors appointments prior to the surgery. He did not come to ANY of the doctor's appointments for this surgery or any other doc appointments our son has ever had. Our son will soon be 7. I also called him this morning an hour and a half before the surgery to remind him. I have completed several co-parenting classes in an effort to learn how to handle this guy. I know many mothers hate their ex's but I do not. I'm angered that he uses our son to make me mad and then tries to look like a good father in court when he could really care less... Just because I had a few honest questions doesn't mean I'm a complete idiot. I always try to do what's right because the truth comes out in the end. I don't know if it's just me but you really come across really aggressive. That's just my opinion. The hearing is tomorrow so we will see. I hope for the best for all of us but foremost our son.
