Yes, she did Stealth, and then you told her her opinion was moot.

I did look at her other posts, and I feel this person is being truthfull, and in need of some help.

Why? Because Dad had a copy of "High Times" magazine at his house...and it was a random DEA agent's opinion that people who cultivate marijuana read it? :cool:

No, the guy has convictions. It is stated right here in the post. I still think everyone is drinking some whacky wine, and I need a glass.

I have full temp. custody right now until the 730 eval comes back, there is no determination as of yet. Besides the current conviction back in 96 he sold meth to a police officer and did 6 months. Also, meth was found at his house in 2001. Do you really believe that his long history of drug abuse won't be considered? He had his third DUI with our 10 year old in the car, that is how he was arrested for the pot. In addition he had $130,000 in cash in the the truck, this from a man who has not worked or filed taxes in three years, He is saying his mother gave him the money.

In California your sworn Declaration is just that, it may contain hearsay, wether or not the judge accepts your beliefs or hearsay is another matter. I have reviewed declarations accepted into evidence, claiming I made certain statements or had opinions that were totally false, and I was available to testify and was not called, hearsay happens. It would be better to get a sworn declaration from the DEA agent. You should also get copies of all his court cases and any convictions, you may have to go to the court house for this and it should be included in the EC 730 evaluation as well. A large steel building and solar power in the wilderness suggests hydroplonic gardening.

I think that the OP needs to contact the police in the areas that dad was arrested to obtain copies of the police reports. (public records). Those would certainly be relevant in court. In addition, the records of his convictions (also public records) should be obtained as well.

That's no guarantee of anything....but I would certainly do that.
