Help, Being sued by creditor

Sounds easy enough. I Tried to do that.

They wanted $2500 to do that. $500 a month until paid in full. That would mean selling my only source of transportation that I NEED to be able to get to work to pay the attorney to do this.

Starting to understand why I am asking about SOL now? Because I am SOL!

I guess you don't know what it is like to have your husband walk out on you and lose your house & everything in the divorce.

When you are swamped with bills...have little income and have no choice but to run up your credit cards to to keep the lights on and food on the table.

Sometimes you gotta do what you gotta do. Obviously, I didn't know that this was going to happen to me until it was going down.

So judge me if you will I guess.

Well, I had my wife leave several years ago and I lost a business, an apartment building and two houses -- in total about $600,000 in assets. Yet, I didn't run up any new bills until I had paid everyone.

There is no excuse for taking things that you know you can't pay for.

You know you owe the money. And you let it get to the lawsuit stage. I don't you are going to be able to work something out short of paying them in full. SOL is a valid affirmative defense in court. And you could find the SOL on your own in less than four minutes by simply searching google for debt collection SOL and your state.

If you have that as a defense you really should talk to an attorney. Or you can go to the courthouse and law library and do some research.

I gave advice, call the credit collector and try and work out a deal, you didn't like the advice. sorry.

and don't assume you know anything about me either, I was divorced in June of this year after 12 years of marriage.
You gave bad advice, that only a collector could appreciate.

12 years? Why so long?

How do you make a deal with a creditor if you don't have the money to pay the debt? I don't understand some of the answers here. The OP said they did not have job, had 3 kids and didn't have the money to pay.

It seems to be all about LETS'S MAKE A DEAL. What kind of deal would that be? In the first place the interest that the collectors and creditors are allowed to charge are OBSCENE and should be against the law.

My advice to the OP would be this: If you can't pay it, you can't pay it. I don't know what assets you have, but read up on what is exempt in Florida. Protect your a-- because nobody else is going to do it for you. You have 3 kids to feed and that is priority - not the stupid creditors.

OP - just in case you come back, if you are paying support, that garnishment will come ahead of any garnishment that the creditor gets. Most times, especially with 3 kids, they'll be taking more than the 25% that they could get.

Now, if YOU have any of the children, then they can't touch your income under $500 net. Florida is considered a debtor's haven since they have laws in place that disallows garnishment below certain levels for head-of-household.

You have no right to make nasty assumptions about anyone. How would you like it if somebody did that to you?

I thought this board was about legal advice, NOT about judging people you don't even know. If you have nothing to offer the person in the way of advice, why did you post at all (just because you felt a need to make a snide remark?)
Tell you what**************.....YOU support them, or better yet, have him make a deal with us tax payers who are supporting him.

Just a thought!

It's only a couple weeks old Fair, and I had nothing better to do except to take a much needed nap. Contractors, Dogs, Hubby working for 2 day's, being a taxi for my daughter, and so on.

Everything is driving me nuts!

I am however going to the SF Rams game tomorrow!

How are you hun?

Ok Im not sure how to make my own post but i will use yours (sorry) as mine is similar I am being sued for a credit card i had when i was 18 I am now 28 the card limit was 500 bucks they have not contacted me in years and years im assuming my collection was "sold" to another creditor they are suing me for 673 I guess this was balance after late fees and what not also suing me for 1200 dollars in 10 years of intrest.I refuse to pay for 10 years of intrest and will go to court my question is how can they do this I would be ok with settling for origan amount or 50% as is sometimes offered but 2000 dollars for a credit card with a 500 dollar limit when I was 18!!! Please help me i am so dumb to these things but this is just not right thanks ahead of time.
