What is the name of your state? AZ

Our Land Lady keeps turning our water off without any prior notice.....infact she doesnt tell us at all when she is turning it off  It has happened more than 10 times since we moved in 4 months ago. She has interfered with my husband going to work because he could not have a shower for more than two hours. She has kept us from being able to make baby bottles for our infant and told us we could "get water from her garden hose" to make bottles. We have an extremely disabled child who also needs water immediately available.....atleast if we were given notice we might be able to get some bottled water  And we are paying the water bill, does she have the right to do this to us even when it is not an emergency? We have talked to her about the problem before and she doesn't seem to care. I am at a loss as to what we should do. at this point, maybe we should just try to get out of our lease? Thanks for your help.....

My response:

Since you're another poster who isn't telling all the facts, then you may as well move out.

 IAAL I have no idea what you are talking about????? I have writen everything I felt relavent to the situation. If you want a play by play of all comings and goings since we have moved in, I don't have time for that. I just asked if it is LEGAL for a landlord (lady) to turn our water off without notice. Please tell me what "facts" you are looking for, and I would be happy to fill in any blanks.....

My response:

Okay, I'll play 20 Questions with you. First Question: How about telling me (and the rest of us) her reasons for turning the water off? That's just for starters.

Your guess is as good as mine.....most of the time she never gives us a reason. ONCE she said it was to fix a pipe in her horse pasture that she had known about for more than a week, but did not tell us.

My response:

Okay, that was one time.

Now, Question Two: what are the reasons for the other 9 or more times when you asked?

Question Three: What type of housing is this; e.g., An apartment, a house, a pup tent?

Question Four: What is the proximity of your landlord to where you're living?

Question Five: Where's the valve?

Landlady never is forthcoming with "why the water is off", and usually says "It is just for a few minutes" that sometimes turns in to hours....

Question Three: What type of housing is this; e.g., An apartment, a house, a pup tent?
This is a rented house on one acre horse property

Question Four: What is the proximity of your landlord to where you're living?
The landlady lives across the street.
Question Five: Where's the valve?
I have no idea where the valve is

When you have answers to questions 1 and 5, then come back.

Suggestion:
Go to Wal-Mart. They sell gallon bottles of water (distilled, Spring, etc.) for less than $1.00 per gallon. Buy two.

Oh, and what did your landlord say when you contacted them in WRITING about this problem and 'demanded' a 24 hour notice prior to water shut-off??

Jetx....
I wish the answer were that simple. I have no transportation to get to Walmart to buy gallon bottles of water, nor, would I be able to go anyway as I have to be with my handicap child all the time. If I wanted to have to do these things I would not have rented a place with in door plumbing.

If I had the full answer to question #1 I would have given it to you. I have been told that the water is usually turned off due to issues with irrigation or issues with leaking pipes in the horse pens.....today it was because they were putting in a new water spiget in the new corral that they have been building for a full week and had plenty of time to let us know they would be having the water off.

The valve, I have discovered in on the west side of our house. Though I don't see that it has any relavence to the legality of turning our water off without prior notice.

A simple "yes" it is legal or "no" it's not would suffice.....even a "it's questionable" would have been fine. If I had known it was going to be this difficult to get an answer here I would have just waited and phoned my lawyer on Monday.....in the mean time I am still with out water and being told to make baby bottles from a garden hose. And yes Jetx....I do get to the grocerie about once every month, that doesn't help my current predicament does it

Yeah, but see... we do this for free.... and the forum 'owner' has said that in lieu of payment, we get to be smart-asses. I am just getting what I am owed. :D

Then why didn't you just do that when you realized about our answers?? Instead, you keep just coming back for more.

[qutoe]in the mean time I am still with out water and being told to make baby bottles from a garden hose.[/quote]
Hell, if it was good enough for your 'momma', why isnt' a garden hose good enough for you???

And yes Jetx....I do get to the grocerie about once every month, that doesn't help my current predicament does it
From your first post: "It has happened more than 10 times since we moved in 4 months ago". So, what is your excuse for not buying a few jugs during your LAST shopping excursion???

My response:

And, why haven't you called your attorney LONG BEFORE?

You see, you're not telling the complete story. You THINK you're telling it, but you're not. You're not turning on the water yourself - - you're just putting up with the situation. You're also not guarding the water spigot. Hell, I'd be out there with a shotgun, telling the landlord or whomever else, "You even THINK of touching that spigot, you're going to get a load of salt in your ass!"
