What is the name of your state (only U.S. law)? Texas

My ex husband has 2 of my children, and won't give them back. We have joint conservatorship, and I am the managing conservator. He was supposed to pick them up for a weekend during the summer, then refused to bring them back. He had an attorney draw up some papers to modify the custody, but he never filed them with the court, so our original decree is still in effect. He took the papers he had drawn up to their school and withdrew them. I do not know where they are, and am in great need of some advice. The children he has are 15 and 17. Is there anything I can do about this?

What does your current order say? Is that the one addressing the joint conservatorship?

Why don't you know where they are? Has he moved? How long has he had them? When were they meant to be returned?

Also, have not your 2 teenage children picked up a phone and called you at some point since the summer? If so, you couldn't/didn't ask them the address?

Yes, the original decree is the one stating me as the managing conservator. I don't know where they are because the adress that I have is not occupied, and he was suppose to return them in June. I contacted the legal aid for my area, and they said they were unable to help me because of financial overload or something.

I talked to them a couple of times, but they assured me they were coming home, and they said they were living at the address that I have. No they don't talk to me on a regular basis, they know it is wrong!

You haven't seen them since JUNE?!

Why is this the first time you're doing something about it?

They know what is wrong? Not coming home, or not calling? They couldn't even tell you what school they are in?

This situation doesn't have anything to do with this does it:rolleyes:?

About six months ago, police officers knocked on the door of my house. They did not have a search warrant, but did have a consent form. My husband gladly signed the form, because we had nothing to hide (so he thought). The officers then proceeded to come in and " search " the house. The problem there is they said someone had reported that we were transporting drugs, and they went directly to our dresser, pulled out the drawer, got a box out that contained baseball cards, and " found " a small bag that contained cocaine.... 0.02 grams to be exact. My husband took all the blame of course, he didn't want me or my daughter to be charged for this. I am just wondering if there is a possible way to beat this case without alot of money.
BTW, in this quoted post, you talk about 1 daughter, yet you have 2 kids in your original post in this thread. Which is it?

No I have not seen them. I have tried to contact him, but he just texts me with threatening messages. I did attempt to do something, but I was denied. I do not have enough money to hire an attorney, and the legal aid people said they were unable to assist me.

They know the whole situation is wrong!!! They won't even let me know that they are ok, or how they are doing in school.:(

Have you checked out the schools for the area you believe them to be in? If you have the court order, the schools should give you the information you are asking for if they are enrolled. Why aren't you going to try to file court papers on your own? There should be a child advocacy office somewhere that can help you in filling out the paperwork you need to file in court.

Look, we want to help you. But none of us are dentists - we can't sit and pull teeth all night. You're going to need to give us details, k?

Like what does the bolded mean? Could you please elaborate?

What kind of threatening messages are you talking about? What EXACTLY does the visitation/custody order say? Is it vague? Is it specific?

Why do YOU think the kids were telling you untruths? Is there something we're not being told? Please - you have to be honest with us if you want help.

Yes, I contacted the schools close to where I thought they were.... they are not enrolled at any of them. I even went to the house to see them, that's how I found out they weren't there. I even called the police, and they said there was nothing they could do to help because he is their father, and they could not get involved. They told me to hire an attorney, because he is in contempt of court, but like I said, I do not have the money. I just started a new job, so hopefully I can find a low cost attorney since legal aid was unable to help me.

Ok, I asked once how many kids you have, and you blew right past it. Might be something to come clean on if you want accurate advice.

Also, are you sure that Dad didn't file anything with the court based on the fact that "About six months ago", step-dad got arrested for a drug related felony?

Wait, you blew past that too:rolleyes:...

Yeah. I know.

Curse my hopeless optimism.
