I have just been in contact with the Attorney Generals office and the state medicare fraud line in the state of Kansas.And the IRS, SRS and everyone is appalled at what is happening but can't seem to help. My 80 year old mother that is in a nursing home is being exploited on the world wide web. Her sons have video's of her after her stroke taken in the ICU 2 years ago, showing them on their web-site and then asking for donations.
My mother never gave permission, let alone would know what a web-site is. My sister just got POA, we have heard it is to late to do anything about this now since it was done before hand. This is in the state of Kansas. Thank-you

What a scam!! Have you talked with an Elder Law attorney? I do not deal with internet law. There is a section in this forum where you could pose your question regarding this internet scam should no one else come along and reply to this thread. Also, local TV stations have consumer reporters that like to expose scams. Perhaps one of them would be interested in exposing the scam artists on the local news.

Contact your local FBI field unit and report internet fraud, that is the proper agency to report this to, that is why no one else can help.

Thank-you for your help, we will contact the FBI and the local newspaper. We check their site daily as to see what else they have come up with. I was so upset when I saw the Video, it made me sick. Thanks again.......

If I were not a judge, I would tell you to send over a couple of cornhuskers to break their legs, but since I am a judge, I cannot advocate that you send over a couple of cornhuskers to break their legs.

That is much kinder than what I had in mind. And, it certainly wouldn't leave them with a tingly feeling. :eek:

:) I know the feeling, we have contacted the IFCC, thats were the FBI directed us, I'm not done yet. And I won't tell anybody about the cornhuskers :rolleyes: Thanks so much...

Small claims

This will sound bad to some, however the case's are many against two family members. Wire-fraud, illegal display of picture's, video's, slander, copyright infringment, harrasment, hacking, trademark thieft, on line threats, etc.
My questions are;
1. if we take them to small claims court and lose on any of the complaints is the verdit final, not allowing another suit against them.
2. We don't want to have a separate case per-complaint, so should we put all complaints together, being they all concern the same circumstances, having one big small claims session.
I know we need a lawyer, however they have the deep pockets and is why they are getting away with this. I wish I could get more indepth about this as my 80 year old mother is the real victim, Thanks for your info........

You have not provided enough of an explanation of what you mean by "being exploited". There may or may not be a valid case to pursue.

nightrider, it would be best to keep all the stuff together rather than start new threads. If you want, I'll paste a copy of this and the other thread in small claims on your very first thread. A lawyer can petition the court for permission for a POA to appear in court on behalf of your mother. What's up with all those charges you posted in small claims? Are those the charges the IFCC told you that your scamming brother's have committed? Is the IFCC investigating all this?

Thanks Dandy, our brothers have built a web-site posting video's, picture's, asking for people to write letters to our mother, now asking for donations. We have contacted many office's and no one can help as of yet, [see my other post] the video's show our mother in iCU after her stroke, why? beats me, to get people to feel sorry for her enough to send them money! We now have been sent to the Missouri Attorneys generals office for consumer fraud, but we want this web-site down, banning them from using her. I have wrote a book on my mothers life and they are mad because mom let me and told me what she wanted in the book, they have bashed my moms book all over the net and started this one site to continue to devalue my copyright and make money for themselves, my mom is 80, in a nursing home, where my other sister [poa] see's her daily, so question? can the POA take them to small claims or? to get them to remove web-site, we don't want money, just the site off. Thanks

sorry for all the post, everyone we have talked too don't know what to do with it, they have never heard of such a thing. I wrote a book that I started 20 years ago, mom spent two weeks with me to finish it, it came out this year. My brothers are mad because I might make money, so they bashed my book on B&N, Amazon, P.A, hacked into my web-site, slandered me and my sister, made a web-page stating why buy the book when you can hear it for free, using my name of the book for their web URL, on and on, they will not quit, heck the DR Phil show called us! But what makes me sick is showing my mother at her worst on their web-site, we have talked to a lawyer that said we had a cut a dry case on some of the alligations, so my real question is can the POA sue on behalf of mom to remove web-site, please cut&paste together Blondie...thanks

Your sister, the POA, can hire an attorney for a civil suit on behalf of your mother; however, the attorney will have to petition the court for the POA to appear in court on behalf of your mother. Given the condition of your mother, it will be a very reasonable request.

The fraud and other criminal charges will be investigated by the proper legal authorities. Yes, it will take some time. Criminal charges will be filed by who has jurisdiction - the state, the feds, or both. Have you also called Adult Protective Services to find out what they, APS, can do and/or advise?

You and sister may also want to ponder applying for guardianship/conservatorship for your mother. Guardians/conservators do appear in court on behalf of the ward and do not require permission to do so. They only require permission to file a civil suit on behalf of the ward. I also do not see any good reason that a judge would decline this request. Guardians/conservators can do things that POAs cannot do.

Mom has always made her own decisions, we just got the POA 2 weeks ago. Really just the pass few months her memory is lacking, When the book came out in Feb the boys went nuts. You have know idea, its another book. Guess we need to do the Guardian thing, we just want them to stop.

Yes, you do have to use the proper jurisdiction. Since this is all happening in MO, have your sister make an appointment with an attorney when you both can be there. You and she need some counsel regarding filing the complaints. I would not post the link to all this. There's scam artists lurking around this forum site. You have enough to deal with with the scam artists that you know never mind strangers. I'd be interested in this and would not disclose the info as I have done so and still do so for others. You can send me the link via private message. You need to go into your control panel (user CP) and enable it. Do follow up with IFCC. Have your sister call Adult Protective Services too.

This is so silly, my mom owns nothing, has nothing, however to protect her from scam we will. Do we need a Attorney?, this would really only be needed to force them to stop using her for consumer fraud. Even if they give the money to a charity, how can someone with no SSN be trusted to do just that?
Reading the book on her life explains everything, she is a very privite person, How about invasion of privacy? When she was in the iCU being filmed, I'm sure knowing then, not that they would put it on the web two years later. Thanks Blondie
