The accuracy of radar or lidar is usually +/- 1mph - well below that 5 mph threshold.

Of course, around here no one would ever get written for that speed - it's ridiculous. Stopped maybe - for a fishing expedition, but not written.

Of course, the OP may have simply gotten a break on the speed.
