Actually, even though they say it's not refundable, they will generally fix it had you done so in a timely fashion.

The problem, young707, is that you are expected to know what you are agreeing to before agreeing to it.

If you pester them enough, Hilton might try to appease you in some way just as a goodwill gesture (to get you to go away) - even though, based on all that you have posted, it does not appear that Hilton has any obligation to do so. A lawsuit is unlikely to change that. I doubt you will get a full refund.
