Florida - We are an end unit of 12 townhouses - we have an "easement" that connects the common area in front (street/parking) to a common area in back (dock/seawall.) The pathway is used by service people and other unit owners to move tools, debris, etc. that would otherwise be cumbersome and inconvienent to move through their home. It also allows these service people to work on their boats, decks, etc. when they are not home.
I have observed some situations where our property was damaged (ie a guy carrying a ladder turned around while holding the ladder sideways and broke a new post light.) by other unit owners "intrusions." The easement is available 24/7 so often times we are not there & don't see these things happen. I am particularily concerned about the liability issue and would like to know if this "easement" which we own, is imdemnified by the HOA insurance or are we "liable" for any and everyone who uses this area?
